Can someone in the military who is stationed in NY purchase post ban mags for their use or do they have to be issued to them to be kosher in NY?

the awb language states .mil members are exempt from the AWB as it pertains to official duty only. In reality since many troops supplement .mil gear with personal purchases, the prevailing situation at the shops I frequent is that as long as you have a current .mil ID they will sell you post ban high caps. Wether this is legal in the bureacratic sense I can't say-
I can't see a cop giving a .mil guy a hard time for having possession of an AR or beretta mag of post ban configuration but beyond that I'd start treading very lightly.
FYI I am a retired .mil guy and while I was in used the crap out of post ban mags for knocking aroung the range in berettas and ar's- before I retired any post bans I had in my possession went back to the unit- I even made a deal to get a few prebans the unit had laying around still by buying new post ban gi mags and trading them in- I get the legal pre-ban(albeit used) the .mil gets a brand new mag- win-win

Nope...they can't buy high cap post ban mags for personal use...unless it's for official duty use (like an MP), military has to comply with the AWB.

At least that's what i've heard on here time and time again.

There was just a  case discussed in a thread about some guy who was in one branch or another who had been charged for possession of a standard capacity post-94 mag and the case was dismissed due to his membership in the armed forces. Anyone else  recall the thread?

Thats says two things to me...1) Some Cops will still go ahead with the arrest and 2) a nolle prosequi or something similar doesn't establish binding legal precedent, so it could happen again.  Stupid state...
