Maybe someone can give me some direction here short of getting a lawyer in Florida. I'm stuck trying to follow the VAF process so as not to be delayed in purchasing a long gun . Back in 71 I was arrested for having a beer in a resturant in Fort Walton Beach. I never did have a beer just an empty glass. Two sheriff type straw hat good old boys escorted me out of the resturant .Because I put my hands up and never touchedNY anyone they charged me with a Disorderly Conduct which is a misdemeanor in good old Fl. 
In Some other state it would have been a violation .Any who, now everytime I go to buy a long gun I get delayed for this stupid so called misdemeanor. I would like to have this resolved expundeged or removed so I am no longer delayed. additionally I would like to apply for a pistol permit in NY and am afraid of being denied. If I'm denied and reapply a question will be "have you ever been denied a pistol permit before". I would have to answear "YES" Any help from my New York freinds would be most helpful. I already did post in the Fla Hometown fourm I wanted to hear some feedback from NYS. Do you have a good lawyer in Florida to refer if required Thanks |
| Well I know I got a burglary 3rd charge and filled for my pistol permit and was granted one, I went to get a pistol at a gunshop after I got my permit and was denied. The gunshop told me about the VAF form, I called and talked to ATF about it and there were very helpful as how to fill out the form and what I would need to get the UPIN. After sometime I contacted ATF again and they said that I should be getting a notice as to rather I was was getting it or not. A long story short I do have the UPIN now and it took some time to get it and now I get a delay on an answer but by having that UPIN my info is easier to obtained and worse case a delay now instead of getting diened |

Thats what I was trying to get the UPin # unfortunatly NICs thinks any type of MM is considered domestic abuse. With a MM in FLA its like impossible to ever get a UP. Last resort is to get an attorney involved which I think is absurd. Maybe I'll try to get a pistol pemit anyway. Thanks for the encouragement

Up to this point I've just about done everyhthing that is required and honestly i'm tired of being caught in a system with no end. I'll try to see how far I can get on my own. The actual charge is disorderly listed as a MM with a severity of misdemeanor Fort walton Beach PD the arrest was in 1971 and I was 17 years old. The Ft Walton Beach PD put an extra screw in me and charged me as adult.
The disposition is unknown 5-23-1971 I never went to court and a see a $52 dollar fine was paid. Maybe one of my parents sent the money as I was away from home working on a cross country moving van. Need l say the job was way to hard and I made it as far as florida. Now you know the arrest of the story Thanks for your help and lets see what I can do on my own. Dan |
