I am going to purchase a handgun from a dealer in Texas, the gun is not NY compliant at the moment (does not have fired shell casing for DNA). The gun will be shipped to a FFL here. My question is - how do I get it compliant (fired shell casing with NY State troopers). Can I just bring it to them or is up to the FFL dealer here to do that before I take possesion? Manny (Assuming that your FFL is willing to do what is required) Once the gun arrives at his store/shop/house he will have to take the pistol to the closest SP barracks that has a shoot tank. SP will then fire the gun and collect the required. Alot of FFL's wont go through the hassle. You could also offer to buy a box of ammo for the person your buying the gun from in Texas and ask him to take it to his local range and put a magazine or two through it before shipping it to you just to check the function and accuracy of the pistol for you and make sure everything is alright before shipping it all the way across country. At that point pistol would be "used" and not subject to the COBIS requirement. |

I think if the gun has been sold to a private citizien than it is used. even if it has not been fired. it is still considered used. and it no longer falls under the BULLSHIT cobis law |

Who does responsibility fall on on a casue such as the OP has stated above? The NYS FFL or the pruchaser? I am running in a similar situation and the NYS FFL says if it comes from another out-of-state FFL then it is considered used. IS the FFL the one that makes the decision?

You must be getting that gun mighty cheap in order to go through all of that. Price of the gun + shipping costs + COBIS costs + transfer fee + all the waiting and jumping through hoops.......
What gun did you purchase if you don't mind my asking? Your dealer would not be able to get one for you himself? |

I have to wait all of a few days , because he goes to the NYSP once a week with the handguns he's sold during the week. The secret is to BUY A USED GUN!
