Since I am a valid Suffolk County Pistol Permit holder, is there and reason why I couldn't build an AR-15 pistol provided it's built on a lower marked "registered pistol", or something to that affect? Thanks, Tony |

| I would have preferred to build it myself but then chrisp 929 mentioned the weight limit, I considered the Bushmaster line of Carbon fiber lowers, however it seems like an awful lot of trouble and expense for a not to practical toy. One of the other members here is selling pistol marked lowers, so I thought a pistol build up might be fun. |

Its entirely plausable to build a pistol here. Go to a dealer and order a receiver, when it comes in have the receipt marked as a pistol. The receiver itself does not need to be marked. Get it put on your permit. The gun will not have to be sent to the NYSP for CoBIS because it was not brought in as a complete gun. Interstingly enough it doesnt apply to used pistols either. Get one of the kits and use a carbine buffer stock (see the huge pistol thread, there is an ATF ruling permitting carbine buffer tubes) Assemble the kit but-and here is the catch- modify the mag release so that the magazine is either fixed or needs a tool to release it. This way you can have a pistol in NY with the pre-ban features but the mag is not removable. You would have to open the gun up to load it or use a tool to remove the mag. ATF was very vague during the ban as to what constituted a tool, if I remember correctly a bullet tip may be used. THe verbage of the ban was that it only applied to semi-autos with a detachable mag. If it is fixed then the AWB does not apply. (meaning niether does the 50 Oz weight limit.) |
You were correct except for that fact. Fed ban stated nothing about tools being required. that was the Cali ban. Tools or not, if it could be removed, it was detachable. |

I once saw a guy at the range with an ak pistol with a detachabge mag. so that was illegal? |
