I have heard about the Tulsa gun-show for years. I have made it one of my bucket-list items. Well, I have time off in November, and I am planning to go - IF.
Big question of the post – Can I as a TX resident with a TX CHL make a private sale out of state? (reciprocity of OK/TX firearms sales) Handguns / Long guns? Thanks JPG |

Long guns yes, but no handguns. Federal law requires handguns go through a FFL. I think this is wrong. You can buy a long gun from an FFL dealer in another state as long as it is legal in both states. Some states have a restriction on this. I do not believe that either TX or OK has one but I don't know for sure. You cannot buy a handgun from an FFL in another state. You cannot buy either handguns or long guns from an individual from another state without going through an FFL. |

Your Texas CHL has absolutely nothing to do with selling a firearm in Texas or any other state. As a "nonlicensee" (as in Federal Firearms License) you can sell any type of firearm to another resident of Texas while you are in Texas. You can only acquire rifles and shotguns from a licensed dealer when you are in another state. You can sell any firearm to a licensed dealer in any state. Quoted:
Long guns yes, but no handguns..... Doing that is a Federal crime. From the ATF FAQ's: Q: To whom may an unlicensed person transfer firearms under the GCA?A person may sell a firearm to an unlicensed resident of his State, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may loan or rent a firearm to a resident of any State for temporary use for lawful sporting purposes, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may sell or transfer a firearm to a licensee in any State. However, a firearm other than a curio or relic may not be transferred interstate to a licensed collector.
[18 U.S.C. 922(a)(3) and (5), 922(d), 27 CFR 478.29 and 478.30] Q: From whom may an unlicensed person acquire a firearm under the GCA?A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee’s premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes. [18 U.S.C. 922(a)(3) and (5), 922(b)(3), 27 CFR 478.29 and 478.30] |

Thanks JPG I just put my exp. at Tulsa in another post about it. Brother, save your time and money and skip it. It was a waste. You should go to the "Small Arms Review" show when they have it in Phoenix, best show ive ever been to. |
