I work @ MD Anderson:
"On June 1st, 2010 at approximately 2:00am, four persons came to MD Anderson to talk to an MDA employee, a former friend of theirs. An argument ensued and one of the suspects threatened to “pistol whip” the MDA employee with the rifle the suspects had in their vehicle. The MDA employee was able to call the University of Texas Police under the pretense of getting the suspects some money. UTPD officers responded to the call locating the parties outside the Alkek entrance. UT police detained the 4 suspects and were able to locate a fully loaded SKS Assault Rifle in the trunk of the suspect’s car. Nobody was hurt during the incident. Jennifer Martinez was arrested and charged with Terroristic Threats and Timothy Gonzales was arrested and charged with Possession of a Prohibited Weapon. Both individuals were incarcerated in Harris County Jail."

Other memo:
"On Tuesday, June 1, an employee contacted UT Police after four individuals arrived at the Main Building, threatening to injure another employee. UT Police detained the four suspects and located a loaded assault rifle in the trunk of their car. One suspect was arrested and charged with making a terroristic threat. Another was arrested for possession of a prohibited weapon. Read the June 3 bulletin from UT Police.

With a growing work force and patient community, we face a bigger set of occupational challenges, including incidents and threats of workplace violence. The University of Texas Police Department wants you to recognize the warning signs and use the institution’s resources to respond effectively."


I'd like to know more about the "possesion of a prohibited weapon" charge.

SKS normally wouldn't be on the prohibited weapons list unless modified.  Could be he was a felon though and possessed a prohibited weapon as a felon.




§ 46.05. PROHIBITED WEAPONS.  (a) A person commits an 
offense if he intentionally or knowingly possesses, manufactures,
transports, repairs, or sells:
(1)  an explosive weapon;                                                    
(2)  a machine gun;                                                          
(3)  a short-barrel firearm;                                                  
(4)  a firearm silencer;                                                      
(5)  a switchblade knife;                                                    
(6)  knuckles;                                                                
(7)  armor-piercing ammunition;                                              
(8)  a chemical dispensing device;  or                                        
(9)  a zip gun.

§ 46.03.  PLACES WEAPONS PROHIBITED.
       (a)  A person commits an offense if the person intentionally, knowingly, or recklessly possesses or goes with a firearm, illegal knife, club, or prohibited weapon listed in Section 46.05(a):

               (1)  on the physical premises of a school or educational institution, any grounds or building on which an activity sponsored by a school or educational institution is being conducted, or a passenger transportation vehicle of a school or educational institution, whether the school or educational institution is public or private, unless pursuant to written regulations or written authorization of the institution;

You can be charged with any number of offenses.   Now whether the charges stick or not is another thing.

At Univ of Incarnate Word in SA, they have the legal 30.06 sings in the parking lot, and IIRC there's an additional sign indicating it (30.06) applies to the parking lot.

Called the local LEO shop, and they said it applied to the parking lot.

I took a pic of the sign and posted it here a few years back.  Will see if I still have it.

A 30.06 sign would not apply to someone who isn't a CHL and who is carrying a rifle in their car. Heck, in my opinion I don't think a 30.06 applies when you are in your car (since you aren't carrying under the authority of the CHL), but that's a topic for another thread.

30.06 doesn't apply to rifles.
