I am reading some conflicting things on carrying where booze is sold. Can i carry into the c-stores that sell beer? ETA, i can not get the pdf file open on the DPS website, this is why i am asking. |
The law is clear. You cannot carry onto a premise licensed by TABC that derives 51% or more of its income from the sale of alcohol for ON-PREMISE consumption. Since convenience stores that sell beer specifically are off-limits to on-premise consumption, you CAN carry into one that sells beer, wine, etc. You can carry into a liquor store. All places that do not allow on-premise consumption will have a sign stating that the consumption of alcohol or beer on the premises is a misdemeanor. Texas Penal Code ยง46.035. Unlawful carrying of handgun by license holder. (b) A license holder commits an offense if the license holder intentionally, knowingly, or recklessly carries a handgun under the authority of Subchapter H, Chapter 411, Government Code, regardless of whether the handgun is concealed, on or about the license holder's person: (1) on the premises of a business that has a permit or license issued under Chapter 25, 28, 32, 69, or 74, Alcoholic Beverage Code, if the business derives 51 percent or more of its income from the sale or service of alcoholic beverages for on-premises consumption, as determined by the Texas Alcoholic Beverage Commission under Section 104.06, Alcoholic Beverage Code; If anyone tells you differently ask them to show you the law. |
