I remember there being a short thread about auto knives here awhile back. I am curious if anyone knows of any potential legislation or efforts thereof in repealing the downright stupid law we have on the books currently regarding auto knives. In most states, a CWP pertains to damn near anything, not only a handgun, but not here..Furthermore, it seems like every first responder I talk to here thinks they have some exemption from the law, when no such exemption exists. I think if they were all educated as to what the law actually states, that they would all jump on board as well. We all know how an auto knife is so much more effective and deadly than a handgun, after all 
So, anyone have any info on this? I think if we got a large enough group of people to sign a petition or something, that we could get some traction behind this. |

That's not how I read it.
45-8-331. Switchblade knives. (1) A person who carries or bears upon the individual's person, who carries or bears within or on any motor vehicle or other means of conveyance owned or operated by the person, or who owns, possesses, uses, stores, gives away, sells, or offers for sale a switchblade knife shall be punished by a fine not exceeding $500 or by imprisonment in the county jail for a period not exceeding 6 months, or both. (2) A bona fide collector whose collection is registered with the sheriff of the county in which the collection is located is exempted from the provisions of this section. (3) For the purpose of this section, a switchblade knife is defined as any knife that has a blade 1 1/2 inches long or longer that opens automatically by hand pressure applied to a button, spring, or other device in the handle of the knife. |

Hmm. I can see your point. i love the legislative wording of our beloved state.
So, what you are saying, is that if I go get a collector's letter, I can buy/sell/trade/carry auto knives? This would only be legal in the county I registered the auto collection inside of though, correct? I remember in the old (now archived) thread that someone talked to their Co. Sheriff about this exact issue. I can't recall which Co., but the Sheriff told him that the collector's letters were only good for possessing in your home, and that you still couldn't carry an auto with it. I see your point now though... |
| I really don't know if the letter is only good for knives in your home county, but I don't read the law like that. It just says you need a letter from your Sheriff to have auto knives as your collection is located there. A collection can be a lot of knives and it is reasonable that you didn't accumulate them all at once in one county. |

But it'd be interesting to see if we could get some traction with something like this in earnest. It just baffles me that I can carry my handgun concealed, but the same permit, background check, etc. doesn't clear me to carry an all-evil auto knife.... |
