So, I have to return one of my handguns to the manufacturer, it is not a recall.  I spoke with them over the phone and they have provided me with a UPS return label.

Can I ship directly to them or do I have to use an FFL as an authorized middleman?

Like mak said, you can do it yourself. Bring it directly to a UPS distribution center; avoid the UPS Store unless you are looking for trouble.

Like mak said, you can do it yourself. Bring it directly to a UPS distribution center; avoid the UPS Store unless you are looking for trouble.  

What kind of trouble? I'm generally curious because my wife took that 1911 80% I ordered to Staples because they are the only UPS store near us to ship  it back to Stealth Arms and she didn't have any problems.


Speaking of which, I still have not seen a credit to my CC and they received the kit on Tuesday. How long do CC charge backs generally take?

When I had to send my XDs back to Springfield, they sent me a shipping label (FedEx in this case), and I called for a pickup.  That way, I wouldn't be in possible violation of the exemptions for handgun possession (does transporting it to a common carrier facility, for shipment to a place of repair, constitute "transporting to a place of repair, for the purposes of repair"?  I didn't feel like finding out).

Firearms are only accepted at the terminal, for both UPS and FedEx.  Franchise stores (like The UPS Store, Kinkos, Staples, Mailboxes Etc., and the like) by policy will not accept a firearm for shipment.

I'm generally curious because my wife took that 1911 80% I ordered to Staples because they are the only UPS store near us to ship  it back to Stealth Arms and she didn't have any problems.

Well, an 80% receiver isn't a firearm, so there's that.  Just as an aside...  I hope you're aware that completing an 80% anything is illegal in the state of NJ  (can't manufacture firearms in NJ without a manufacturing license - even for personal use).

I believe that FedEx does not have the same no-firearms policy that UPS does for their stores.

Thank you all that replied to my query, a lawyer knowledgable on NJ gun laws agrees with the hive.

Now for a follow up question.  When the manufacturer is ready to return the handgun, can he ship it directly to me?

A non-licensee may ship a pistol via contract carrier (fedex, ups, Etc.) BUT... it has to be shipped in an expeditious way (next day, overnight- I don't have the text in front of me at the moment) AND you are required to inform the carrier that there is a handgun in the package.

Your return label may or may not cover the shipping you need.

I believe the overnight/next-day part is just a carrier policy, not law.  The law only requires that a non-licensee use a contract carrier.  And, the carrier is only required to be notified that a firearm is being shipped if it isn't going to a licensee (dealer, manufacturer, importer, or collector).  That basically leaves intra-state shipping, and when one is shipping a firearm to themselves c/o a third party.

However, my experience at both UPS and FedEx says that they will ONLY accept a firearm if it's going to a licensee.  While the feds say it's legal to ship a firearm to yourself, and in many states it's legal to ship to another in-state resident...  the carriers will tell you no.

Back to the overnight thing...  when Springfield sent me their FedEx return label, they also stated:
Pistols are authorized for 2-day air shipment. Please notify the shipping clerk that Springfield has an exception to the FedEx 1 day shipping requirement for firearms.
.  Apparently, at least some manufacturers have worked out a deal with the carriers, because having to pay $60+ in shipping is just the other side of ridiculous.

So, I took the pistol to a UPS central location where they accepted it and shipped it Second Day to Wilson Combat.

Wilson Combat was extremely efficient, as should be expected from a high-end mfg. They replaced the slide and all small parts as well as "hand fitting"  a new barrel.  Exactly four weeks after receiving my pistol, it has been shipped directly to me, also via UPS Second Day.

There is nothing negative I can say about WC's customer service.  They  kept me appraised along the way and replaced parts which were damaged due to "operator error" (me), and gave me a 20% discount on parts plus a free 1911 magazine.  

This WC 1911 45cal pistol was expensive but I do believe had it been a lower quality pistol, the physical damage to yours truly could have been quite significant.

High 5 to WC!

Glad to hear it all worked out well.  What exactly happened to the pistol?
