| I'll be getting out of the army in February . While stationed at Fort Cambell KY i purchased a hangun from a fellow soldier . My question is will i have to get a pistol permit for this handgun when i bring it back to NJ . I'm pretty sure that i don't but i want to be sure . If anyone can help me out i'd appreciate it . |

As long as the gun is legal to own here you don't have to do anything, just bring it with you. Magazines are limited to 15rds or less. My only caveat to this is: - If travelling into NJ by vehicle, pistol is unloaded, magazine(s) are unloaded, pistol is in a locked case, locked in trunk if possible. Ammo is locked in another box. Once in NJ, go directly to your home, and off-load the pistol. Try to stop in PA for fuel/food/restroom, to avoid having to stop in NJ. Don't stop in NJ for coffee or smokes... don't stop at the store to pick up stuff you need... don't stop to visit your anyone. The above encompasses parts of federal law, NJ state law, and "best practices" recommendations when dealing with firearms in NJ. If coming in via commercial air travel... that could get a little tricky. Hopefully, you're driving home. |

My problem is that as a NJ resident, even though you are in the Army, you bought a pistol from an out of state'er without getting a pistol purchaser permit and transferring the gun to a NJ FFL. While he was stationed in KY he was a KY resident as far as BATFE is concerned. He could have went to a KY dealer and bought a pistol with his NJ DL and copy of his orders. |
