It is kind of vaigue, but here is the personal protection exception:
Nothing in N.J.S.2C:39-5 shall be construed to prevent any person who is 18 years of age or older and who has not been convicted of a felony, from possession for the purpose of personal self-defense of one pocket-sized device which contains and releases not more than three-quarters of an ounce of chemical substance not ordinarily capable of lethal use or of inflicting serious bodily injury, but rather, is intended to produce temporary physical discomfort or disability through being vaporized or otherwise dispensed in the air. Any person in possession of any device in violation of this subsection shall be deemed and adjudged to be a disorderly person, and upon conviction thereof, shall be punished by a fine of not less than $100.00.
Per the manufacturer, PepperBlaster II's specifications are: Volume per charge .............................. 0.21 fluid ounce (6 ml) Shot capacity ..................................... 2 charges per unit If my math holds, that is 0.42 oz. Should be kosher. But you can only carry it and use it for personal self-defense. If you brandish it, threaten someone, or use it in any manner that is not commensurate with personal self-defense, the 2C:39-5 exception will be non-applicable and possession would therefore be considered illegal. Similar to the exception clauses to all the weapon laws in NJ, the law-abiding citizen applies the exception at his own peril. |

Per the Manufacturer's Specifications:
Content: 2 charges per magazine, filled with liquid irritant.
Volume per charge: 0.39 fluid ounces So, will NJ give you grief about the capacity being 0.03oz over the 0.75oz limit?
I found one online retailer (http://shop.fortresstactical.com/Kimber-JPX-Protector-p/jpx-kit.htm) that says: We will not ship this product to the following states: Washington DC, Hawaii, Massachusetts, New Jersey, New York or Wisconsin. It is the buyer's responsibilty to be aware of and in complience with all local & federal laws regarding the use of this device.
I guess the laser sight is just too "dangerous" looking for NJ.
