Im just trying to get my head round this one. Is what he is doing illegal or legal? He openly replied to 310Cadet saying they were off his pre-semi auto ban gun. From the picture there is a serial number stamped into the receiver. Shouldn't that rifle and its parts have been collected in and destroyed at the time of the ban? I mean if someone actually tried to use it as part of a functioning weapon, wouldn't the serial number be flagged?

It is possible that he had the gun deactivated and has now stripped it, but from his reply to 310Cadet I somehow doubt it.

Selling as firearm's parts could lead to trouble as the flash hider and the receiver are controlled items and need an FAC. If they were off a deact. weapon then it is legal but this just goes to highlight the stupidity of the firearms laws. Then there is the use the buyer puts them to - stick them on a rifle and they are s5 parts as they are off a s5 weapon but as no one has mentioned where they came from that could be hard to prove.

Unless you are really desperate to have these parts I'd leave them well alone.

                I have no intention to buy the parts. I don't even own an AR15. I was just trying to understand how it is legal for someone to sell rifle parts on eBay and why the gun / parts were never collected and destroyed at the time of the ban. I'm sure there is something untoward with this sale , I cant see the listing staying there till the auction close time. Also if it does sell I guess he will probably get a visit at some point from the boys in blue. What is very strange is that eBay have allowed him to list that even with their strange policies.  A friend of mine once had an auction for a set of reloading dies pulled within an hour of it listing. This seems to have been there a while.

For info,

On a deac the law requires the barrel to be permanently fixed (welded) to the receiver.
The take-down pin holes also have to be weakened by cutting.

I have seen it spelled in two words on many documents and insignia of the era. Not sure which came first - the one word or two word version.

I see it as a piece of metal that shouldn't need to be licensed.....but it is, because that's how the law works.

I'm not a police officer, judge, magistrate or law maker. I have not defined what it is or isn't.
I just see it for the stupidity it is.

And you quite rightly demonstrate that authority ( and unquestioned expert knowledge ) by pointing out breaches or possible breaches of the law relating to firearms to many here in other postings.



So, would you as RFD sell the item as a piece of metal ?



If it were advertised for sale by a member, would you allow the posting or remove it ?

I wouldn't sell it as I wouldn't have it. If I did have it, I wouldn't shout about it on the web.

I did not make the laws, they were in place long before I became an RFD. It's a useless piece of metal in it's current format.
The fact that everyone's bitching about it and not contacting the seller to inform him that he could end up in a lot of soapy-bubble says more about yourselves than it does me.
The guy probably doesn't know that it's a licensable component and could do with being informed, possibly on the QT by someone such as a rozzer like yourself!

I seriously doubt he would end up in the pokey...and if he did, would point out the stupid laws we have in place at present.

If such a part were offered for sale here, I would quietly contact the seller and tell them to dispose of it, not shout about how he's breaking teh lawz.

Funnily enough, I already have e-mailed the vendor.



I pointed out that I was not aware whether it was deactivated or not so the advice I was offering was unqualified.



Attached for his information the references to "items designed to diminish flash" and "components" in the Firearms Act. And suggested he might want to seek advice before proceeding.



Lots of pieces of metal are "useless" on their own. But put together they are capable of being used lethally. Hence the legislation.

There is case in law that there is no such thing as section 5 components, and that firearm components always revert to the lowest classification,

Vendor thanked me for the info but replied that he has seen lots of "spare parts for guns" on sale via EBAY. And if they are doing it then it must be ok.








Well, if it all goes pear shaped for him ( assuming it is not a deactivated or otherwise non-FAC item ) or the buyer, then he cannot say he was not aware............



He infers that he still has a FAC - he will feel a right cnut if he loses it for the sake of £10.49 plus postage.

all the bits he said (admitted in email) were off a s5 weapon perhaps.

Maybe he should just keet his mouth shut and run with it. A little knowledge won't hurt you, but a little bit more can convict you.

Don't forget it's West Mercia's patch. They allow all sorts of dodgy stuff, MP5's, sawn-off shotguns. What's a couple of S.5 bits not even attached to anything?..

Just been on the phone to the local firearms officer, a mate of many years, He said "Well what about all of them deactevated firearm out there ?". Witch is a good question ! As he has a deac M16 and AK47. Any way should be no more problems. Ray

..must have been a day for it.. my friendly FEO called me yesterday to say he hand't been able to quantify a specific restriction on some land I want to shoot over as a collegue was on holiday and would it be OK if he issued the ticket (a renewal after a 10 year lapse as I quit pistol in '97) with the conditions I had asked for and then varied it (for free) when the info turned up... even better, the whole thing has been turned around in just over 2 weeks.. can't ask for more than that... round of applause for great service

now, just what to buy.....

Deactivated pre ban A1 style AR-15?

Highly doubtfull, there weren't many deactivated, (IIRC, there were ≤ 200 AR15's that got banninated in total), and those that were deactivated carry very big price tags.

Would you break up a very valuable deact for peanuts?
