Hi all, I'm sure this has been asked before, but I was looking for some specifics. Also, I did post this in the General Class 3, but I'm looking for Alaska specific information.



I've been sitting on the fence for some time in regards to starting a trust and registering NFA stuff that way, but I'm at a point where this is the route I want to go, due to having family I want to have access to my NFA items. I'm looking for advice from people in AK who have already gone the trust route. That said:




1) How did you create your trust; with a lawyer or with Will Maker or some other program?




2) If you went the lawyer route, who would you recommend and how much did they cost?




3) If you used a program to create it for you, did you add any specific NFA language to it? If so, what language and where in the trust did you insert it?




4) Can you add siblings into the trust enabling them to have access to the NFA items while you are not there (like while I'm deployed), but not empower them to alter anything (like add or subtract anything from the Schedule A) in the trust? If so, to what capacity do you include them in the trust?




I really appreciate any advice and guidance you guys can give. I've been looking around but there is so much conflicting information, I'd really like answers directly from somebody in my AO who has used a trust. I'm looking at buying a can, and I'd like to get my trust set up and squared away ASAP so I can order the can.

Neither for both. AFAIK

i too used quicken willmaker.

i have 5 title II firearms on the trust.

i did not use any special NFA language but i did register the trust with the state as it IS required by state law to do so. funny thing though, there is no penalty if you don't.

i did only because i wanted it to be all squared away in case BATFE gets picky later on.

Thank you so much for the information. I'm looking at ordering a can in the next week or two, and want to get this all set up ASAP. One more question, is it possible, aside from a spouse, to have anybody else on the trust so that they can have access to the NFA items without me being present? If I list (for instance) my brother as a trustee, will he be able to use the NFA items while I am deployed? Also, do you know if listing him as a trustee would give him the ability to alter my trust or remove an item from my trust? Not that I don't trust my brother, of course, only that I'd like to be able to allow him access to it while I'm away but I want to be the only person in control of my trust.



Thanks again for the information, I really do appreciate your time and information! Especially knowing I have to register the trust with the state. Going the CLEO route is just a pain, so I think the trust route will be the way I want to go.

I would think that you could add your brother as a trustee for the dates of your deployment & that he would no longer be a trustee upon your return. But I'd defer to someone with more knowledge. I had my class III dealer set up my trust for me. I think it cost $65. They take care of all the paperwork. When the tax stamp shows up I get the original & 10 copies & the goodies.

Well, I ended up going the Quicken Route, I added my brothers myself after it populated everything. I tweaked a couple of other things in the Trust, like calling my trust CA Trust instead of Conspiro Agnew Revokable Living Trust so I wouldn't have to have all that engraved. The ATF has cashed my check as of the 29th of last month and I am now pending...

You don't have to engrave "Revocable Living Trust". Shorter is nicer though
