I'm probably overthinking this, but I'm curious if my SBR is less than 26", but the ar lower that it sits on started out (and currently is) a rifle lower. Can I legally register this as a pistol if it started out as a rifle lower?
Thank you. |

I was under the impression that "once a rifle, always a rifle".... Is this no longer the case? http://www.atf.gov/files/regulations-rulings/rulings/atf-rulings/atf-ruling-2011-4.pdf You have to be in the frame of mind "Michigan pistol". The michigan pistol registration has nothing to do with the ATF's designation of rifle/pistol. They are two seperate sets of laws and need to be viewed as such, so long as the firearm in question meets up with both laws. (for example a federal rifle but state pistol, both are legal, so your good.) So, built as a rifle, then SBR'd federally, A-OK with the federal law as SBR. it's status as a MI pistol means nothing to the Fed's Built as a rifle, then SBR'd, registered as a pistol in MI (but still federally a rifle, now SBR) A-OK, It's just a SBR that happens to be a "michigan pistol" Also, once a rifle always a rifle isn't true, you can go PISTOL-RIFLE-PISTOL. It only matters if it was "born" a rifle. If it was born a pistol it is legal to go to a rifle and revert to a pistol. The thompson Center contender does this, along with the Mechtech Glock uppers. https://www.atf.gov/file/55526/download |
