This might be a dumb question but I couldn't find the answer anywhere so I figured I'd ask. Are we allowed to travel (i.e. driving within the state of MI) with ammo and loaded mags in the same case with our gun, I know some states require them to be separate but since we don't live in a communist republic are we ok? I know you don't want to get caught by the DNR even looking at a deer with a gun in your trunk, but is it legal to have loaded mags in my case so long as I'm not enjoying the wildlife?

Having loaded mags with your firearm is considered the same as having the gun in question loaded.

Other then hunting regs, I was not able to find anything regarding transporting a magazine or clip loaded.


750.227d Transporting or possessing firearm in or upon motor vehicle or self-propelled vehicle designed
for land travel; conditions; violation as misdemeanor; penalty.
Sec. 227d. (1) Except as otherwise permitted by law, a person shall not transport or possess in or upon a motor vehicle or
any self-propelled vehicle designed for land travel a firearm, other than a pistol, unless the firearm is unloaded and is 1 or more
of the following:
(a) Taken down.
(b) Enclosed in a case.
(c) Carried in the trunk of the vehicle.
(d) Inaccessible from the interior of the vehicle.
(2) A person who violates this section is guilty of a misdemeanor, punishable by imprisonment for not more than 90 days, or
a fine of not more than $100.00, or both.
History: Add. 1981, Act 103, Eff. Mar. 31, 1982.

750.231a Exceptions to MCL 750.227(2); definitions
(d) To a person while transporting a pistol for a lawful purpose that is licensed by the owner or occupant of the motor vehicle
in compliance with section 2 of 1927 PA 372, MCL 28.422, and the pistol is unloaded in a closed case designed for the storage
of firearms in the trunk of the vehicle.

Where the disconnect is that DNR law specifically says "unloaded in magazine and chamber" this is generally only applied if the magazine is integral to the weapon.

FALSE

Loaded mags are fine as long as they are not inserted in the gun.

Transporting ammunition and long-guns
MCL 750.227d describes the lawful way to transport a shotgun or rifle. While they must be unloaded, they may be transported in the same case as ammunition (including loaded magazines).

You can have the ammo in the mags, but the mags must still be stored seperately from the firearm. (the loaded mags)

Or it is considered to be a loaded weapon....at least that is what I was told by an over zealous DNR officer.

MSP and the statue disputes this requirement, but I would follow Dezmo's counsel as it is a good practice.

Gotta disagree with you Dez. Magazines are not firearms. A loaded magazine does not make a loaded gun. Can I carry loaded mags into a school legally? I would think so seeing as how it's not a gun. Do I need to fill out purchase papers for mags? Nope, not a gun. Show me the link to MI law that says no loaded mags, please.

I gotta disagree Blackhawk. The law states That you are supposed to transport ammo in what ever divice its in  in a seperate container. If the ammo is in mags that does not make a difference it still has to be in a container that is not holding the firearm. UNLESS its a registered pistol that is on your person.

OK, let me clarify...   Loaded mags are Ok to be carried. But how I see the the legal update is that it must be seperate from the rifle. ....I.E., in the case, not in the magwell. But as G-Lock says. Its best to keep them in a seperate container alltogether.

And I assume we are talking about Rifles or non CPL holders.

Agreed, a loaded mag in a chamber empty rifle would constitute a loaded firearm. Loaded magazine in same case as empty rifle would be legal. A whore in church does not make the rest of the congregation sinners.
