The words the judge had for the prosecutor don't bode particularly well for their case...


ETA: The Judge was a Clinton appointee, if the .gov ever had a chance at a sympathetic court, this was it.

"Robert said the defendants also must provide a list of names, addresses, and phone numbers for all Hutaree members and members of any other militia groups they associated with."

Since when can a Judge force someone to give up their right to remain silent and not to have ones words used against them. By abiding by that order they are giving the gov potential evidence of a conpiracy, real or otherwise.

Based on the list of restrictions placed on them this is in no way a victory, loss,or any indication of the facts of the case. Its just one part of the legal process (bond hearing) where a Judge weighed the cost of incarceration and the defendants rights (well some rights) against the potential danger to society as a whole and the likelyhood that they will appear for court.

Remember very few people who are facing Federal criminal charges are held on bond. The Fed has very little jail space and pays local county jails to hold defendants. Most offenders, even the high level ones, get low bonds and are usually out pending trial. The difference being with the Fed system your end sentence is usually higher than the State system. Where the State holds more people pre-trial and gives shorter sentences.

That being said, if these guys go off and do something crazy while out on bond, that will all change. The gov likes to be proactive but our laws tie their hands and they are forced to be reactive. If they screw up while on bond, you will see a large reaction from the gov and courts.

Its the convictions, plea bargins, or aquitals at the end of this that will matter.

If they were going to legally hold anyone, it would be these people. Flight risk? If there is a prosecutable charge in there someplace, I'd peg these guys to split (or at least try). Then there would be a cry far and wide to give more resources to the feds to protect us from gun toting militias.

Barring this, and it goes to trial as planned, we won't hear much more about it. The trial will reveal the level of FBI involvement and they'd rather avoid that exposure. Plus, the media already did their demonization job.

Heard on the radio the judge ordered a stay on the release pending another dog and pony show by the .gov to prove they were a threat to society. Supposed to have made their case by 5pm today. Haven't heard any more since.
