One of my best buddies little sister is going through a divorce in TN. It's not going well at the moment and it seams her lawyer has lost his nerve. If you can give a little legal advice send me a PM and we'll talk.

whos the lawyer? has there been any physical violence or threats? if not, dont come to jackson and start any cause our PD takes that shit serious. and if there has been any violence or threats all you need to is to let me know . I will call any one of the numerous officers on our force I know and alert them to the situation. Domestic violence is something that our guys handle with vigor. They will especially go out of their way to be over protective for scared women.
I'm not sure where in Arkansas you are from but I have had bad experiences with a local law enforcement agency in Arkansas not doing a good job with a domestic violence situation. And the DA did an even worse job. We run a tight ship around here. |

There has been domestic violence recorded and a protection order in force. She has been in the process of moving back to AR on the weekends. She has legal rights to the house since she has a child of her own. Monday her sill husband moved back into their home while she was in AR and changed the locks. She called the local PD and they said it was a court problem since his name is on the house deed. They walked away. Her lawyer just yesterday "asked his lawyer" if she could come back and get the rest of her stuff. I believe he should have filed a motion to have him removed as the judgement clearly stated that she has the rights to the house until the final settlement.
We are hoping that he will allow her brother and I to assist her in getting the rest of her stuff this weekend. If they do not answer the request we will still go but we will stop at the local PD and show them she has the legal right to her home and hope they will assist us in entering the home. Wish us luck. |

I dont think it has anything to do with HIM allowing anything. Are the marital assets still in dispute with the divorce still ongoing? If so, you may legally not be able to take her stuff. When people are married, most things become joint property, and until the judge advises the disposition of assets you cant just take "her" stuff. PM the name of her lawyer and I will tell you if he is competent. Specifics are important around here. For the most part our Judges get the job done the best way it could be done. On a personal note........I am SOOOO tired of divorces where the guy is violent and asshole...........but I'm even more tired of all these women who delude themselves and marry these jerkoffs. I have a truck and a trailer and a pretty good storage facility.........in the past 2 years i have helped 5 people move their shit because they were getting divorced. I am not a religous person, I was raised nominally baptist, but i still think that an Oath for life before GOD almighty to love and cherish is abandoned at a fucking whim these days is crazy. rant off |
| Deadeye is right, Tennessee is a joint property state whoever is in the house pretty much has it until a judge signs off on the order that determines who gets what. While it also applies to her, most judges frown on the other party breaking in to retrieve property. Most sheriffs depts will do a standby to make sure there are no prolems if he will let her come get her stuff. |
| There has been a trial and a judgement ordered in her favor. He has 30 days to appeal said judgement. She is to receive payment from him within that 60 days or she can sell the home and keep her part of the money. Basically he will keep the house but he must buy her part out. UNTIL then she has the property rights. She has a court documented lien on that house. The only property she is moving is her personal clothes, jewlery and a few items of the same for her daughter. |

| Well she has not received a reply for her request to remove her property from the home yet. We hope to get it today but it is his fashion to delay any proceedings just to aggrivate the situation. We will be heading that way this weekend. Is there a fellow Arfcom member with a Tennessee badge that would like to help out? We will go to the local PD first but someone here might be willing to attend. |
