A friend went in to pick up his new SR-15 today. His background check came back with "delayed". He was told it could take until May 18th to get it through.
I thought there was a law that said a background check has a certain time to be declined or it is approved by default. Am I dreaming or does this sound familiar to anyone? |

OSP has 30 minutes to say yes or no. If they can't give an answer in that time frame they have to give an estimate on how long it will take. Federal law will allow a transfer without authorization to take place 3 business days after the request is made. This is at the discretion of the dealer, meaning they don't have to do it and most likely wont due to the liability issues the previous post pointed out.
I am pulling this out of Kevin Starrett's book "Understanding Oregon's Gun Law's". I just read this section the other day and thought it was interesting. |
