"New Senate Bill to Require Background Checks at Gun Shows
No background check, no gun, no excuses.

Dear brian,
Gun Show Loophole Press Conf with VT Victims
Virginia Tech survivor Lily Habtu joins Senators Lautenberg (NJ) and Reed (RI) at press conference to announce new Senate bill aimed at closing the gun show loophole.

We started this year with a huge victory — thanks to you and our many allies — with a new law that will strengthen the Brady criminal background check system!

Now we need to keep up the momentum and take the next logical step: make sure that everyone who wants to buy a gun gets a background check.

Earlier today, Senator Lautenberg (NJ) introduced legislation that will keep criminals and other dangerous people from buying and selling guns without Brady criminal background checks at gun shows.

Gun shows should not be a haven for convicted felons, domestic violence abusers, or someone who is dangerously mentally ill who wants to evade a background check. Letting criminals and other prohibited purchasers get away with buying guns at gun shows is at odds with common sense, and recklessly puts lives at risk. We believe the law should be "no background check, no gun, no excuses."

Whether they are called gun shows, flea markets, or swap meets, there are thousands of events every year in our local communities where unlicensed individuals can sell firearms without doing background checks. (Federally-licensed firearm dealers at the same event are required to conduct Brady criminal background checks.)

People prohibited from buying or possessing guns seek out these unlicensed sellers, because they know that they can simply put down their money and walk away with deadly weapons.

Law-abiding gun buyers and sellers have nothing to fear from background checks. Only criminals and corrupt sellers do. Allowing dangerous people to buy guns at gun shows from unlicensed sellers without a background check threatens the safety of our families and communities. "

You know, c'mon

The gunshows where they sell all those guns used for mass murder really cheap to anyone who wants one.

I'm guessing more people suffer because of medical mistakes and naturopath quackery.

Gun Show Loop Hole = code for LEGAL private sale / transfer from citizen to citizen.

This is an effort to make all sales go through FFLs. It is a precursor to registration.

BTW I was reading on another forum wherein a poster from the UK was talking about registration....the law of his land has DEvolved to the status that if you have 'no practical application' for the rifle you get a visit from LE and they make you sell the rifle in question. In his case it was an AI AW .338. Private ownership and control of handguns? Non starter.

The Gun Show Loophole...

Isn't Oregon's background check at gun shows a state law?

When I was in AZ, there were no background checks at gun shows on a deal between non FFLs. cash and carry.

So what they want is a federal law like what Oregon already has.

Look at that guys, we're already ahead of the curve.

How progressive.

Yep. We can thank "Republican" Kevin Mannix for that. I'm so happy he lost the last primary. If not for him, my first gun could have been even more unregistered.

I find it funny that they mention VT in relation to the "gunshow loophole". IIRC the shooter bought his weapons fron an FFL (and passed all his background checks).
On a side note; I really got a kick out of the "American Dad" show where he went back in time and stopped the Regan assanation attempt. No attempt, No Brady Gun Snatchers.

I remember quite well the TV ads McCain ran in Oregon to promote his support of the "gunshow loophole" bill in the Oregon legislature.  And yes, it did pass thanks to republican support for it. Nothing like standing up for our rights with a whimper and panting tongue.

McCain was disgusting on the debate last night. He oozes lies and slime.  He was a military hero in his Vietnam days, but as a politician he has grown wacky and opportunistic.  I'll never vote for that fruitcake.

If you want to keep your guns, then anyone is better than Whackjob McCain.

Is there anything in Oregon law that says "Meet me in the parking lot across the street in 15 minutes with the gun, I'll bring the cash" is illegal?

Not to totally derail this but let's talk about him for moment. I would suspect most people like me have little to no idea about him being a "hero"  - so I googled it. At best, one could say his "hero" status is contested. What one can say is that he is both the grandson of an Admiral and the son of an Admiral (Edmond John McCain) - a sitting Admiral at the time of the Viet Nam war. He finished at the bottom of his class at the Naval Academy (894 out of 899). He flew about 23 missions in total; and was shot down over N. VM. He traded info for medical care. He has many (as many if not more than Kerry) former service personel that have negative things to say about him. The medals that he earned seem to have been awarded in a manner not necessarily consistant with the standard of how these were to be awarded at the time.

I encourage everyone to google the subject for themselves.

Both parties must be US Citizens, OR residents, of age, and not otherwise legally barred from owning a weapon. The weapon must be legally owned to be legally sold.

I've done several deals just like this. I typically get the serial number and call OSP and ask if they can run it to show if it is stolen, I show my CHL when buying and draft bills of sale for both parties to sign - these last three steps are for the warm and fuzzy factor - CYA but are not required.

However, if you say "Meet me in the parking lot across the street in 15 minutes with the gun, I'll bring the cash" while at a gun show that WOULD be illegal under Oregon law.

I don't believe that there is anything in the OR law that technically requires either party to verify anything.  My understanding is that if you sold or bought it and had any reason to believe it was stolen, or the buyer was not a resident/US citizen, then you could be in trouble.

Now, I think most of us would use enough judgment to go some way beyond the letter of the law.  Only buy/sell to friends and family.  Or ask for a drivers license. Don't sell in prison parking lots (just kidding). Some will only do transfers via an FFL.

I have not sold or bought  FTF in Oregon and I was wondering other than using an FFL or selling only to friends, where do you guys recommend doing a FTF?  I sure don't want someone arriving at my house that I have never met yet, nor would I like to be exchanging at some remote location.

I think I would stick with transaction just with family and friends for now, but if i saw a good deal on an AR lower or upper, or another Glock I might be tempted to do a buy.  I hope to heck I never need or want to sell another firearm, but you never know.  So far all my sales have been to dalers and you take a bath that way.

NWP - I really do use parking lots. My last was at an Elmer's Pancake House, before that a Freddys. I've also done deals in the parking lot of The Place To Shoot.

When selling FTF I always meet in a public place. If it's a gun I do a receipt with ODL number, 1 copy for each party. BSW

Wonder how many dipshits actually fell into that.
