So, I get a phone call from an attorney today about a really stupid lawsuit involving one of my customers that MY name got drug into......and they want me to testify because I helped with some wiring for the guy. He took on a project redoing an old Jeep truck, and the wiring was hacked all to hell. He has me order a Painless harness for it......then six months later asks if I'd install it because all the shops he talked to wanted a couple grand to do the job. The next few days off I had, I came down to his shop and did the wiring.....took about 14 hours, but looked like factory. I thought my involvement ended there, but NOOOOOOOO........ Almost a year later, the truck owners son, who is a customer of mine also, calls to ask me a bunch of questions about what I did and what I had been paid.....WTF!?!?! I find out that the truck owner is suing my other friend because he said the bill was too much.....so, my buddy is countersuing because he the truck owner won't pay..........So, I get called by the other sides attorney today about testifying to my involvement in wiring the rig, but both sides don't seem to dispute how much time it took me or what I got paid.....it has to do with my buddy billing the guy $25/hour......it was his shop! I just helped at a discounted rate to get the job done....and any other shop woulda charged upwards of $70/hour!!!! If this doesn't define frivilous lawsuit, I don't know what does. Sorry, I'm just pissed right now...... |

Tort reform doesn't work. Look at California among many. Sorry to hear about your unscheduled time in court. A civil subpoena is not properly served unless you get your witness fee by the way. It is pretty lame the guy won't pay. Actually sounds like it ought to be in small claims. When you charge a Wal Mart price you get the Wal Mart crowd. A new twist to the no good deed goes unpunished. |
Oh, I know it...and after I started getting a bit hostile with the dumbass, he said "Oh, well we can pay you your hourly wage........" Sure, I said, and it would be cutting into my overtime, so time and a half you douchebag........ Whats stupid is the whole $25/hour bit. They trying to say they should only pay the $200 he paid me for the wiring.......If a contractor bids a job at $50/hour, and subs a portion of the work out at $25/hour, is he going to refund the customer the difference per hour? Hell no! |
I try to be. My folks weren't religous people, but the were very morally just people, and thats what they instilled in me and my sis growing up. |
