Gwinnett County, GA —

At least one local district attorney thinks the outcome of the George Zimmerman murder trial could have turned out much differently had it happened in Georgia.

Gwinnet D.A. Danny Porter tells WSB’s Sandra Parrish that under Georgia law, you have to meet a higher standard when claiming self-defense.

“In our self-defense statute, it says that self defense is not available if you’re the initial aggressor unless at some point you withdraw from the combat and communicate it,” he says.

Porter says since the 911 operator told Zimmerman he didn’t need to follow Trayvon Martin, under Georgia law he could have been perceived as the initiator of the conflict.

“The idea that he went further, particularly after being warned by the 911 operator, may have presented some problems under Georgia law,” he says.

While Porter says he can't say how he would have tried the case, he does believe Zimmerman would have had a more difficult time mounting a defense here.

Porter is showing his ass.
His comments indicate he not aware Mr Zimmerman's testimony on what happened that night.

I suspect Porter, like all politicians, could not resist running his suck when the media thrust a microphone in his face.

On a positive note, Mr. Zimmerman is alive and Martin is dead.

Haven't had any dealings with Porter for many years but there was a time when he was approachable and best of all VERY pro-gun but something changed about 10 years ago.

He signed numerous form 4's for me and many others when I lived in Gwinnett but he abruptly stopped signing for no apparent reason and refused to discuss the situation telling everyone it was the sheriff's job.

I like it when politicians use terms like "may" and "could" to explain their BS opinions.
Well, the facts indicated it was self defense. I am glad the real jury saw thru the prosecutions emotion and fellings.
Z was tried because he killed TM. The media and the public could not understand the term "justified under FL law"
Zimmernam took a beating before he shot Martin.

Prosecutors get paid to prosecute.  The only people they DON'T want to prosecute are those that they don't think they can SUCCESSFULLY prosecute.  All others are fair game, whether they're guilty or not.  Danny Porter is only telling the media that he's a better prosecutor, and he would've done a better job prosecuting an innocent man.

Another thing that really chaps my hide is the implication by anyone and everyone that Zimmerman disobeyed a lawful order or that he broke the law by not listening to the dispatcher. First of all, unless the dispatcher is a sworn, oath taking, police officer, they can't order you to do jack squat, and even then they're limited on what they can do. Most likely she is civilian call taker. Secondly she said, "we don't need you to do that", not, "Sir, stop following him." Not exactly a direct order if it was intended to be.

Even if Zimmerman really was following Trayvon (which is what I believe), it's not a crime. The first illegal action was taken when that first punch was thrown.





roy d...now if you want to debate who threw it, go ahead. But no evidence exists.
