guy on another board is selling an M&P 15-22 to cover some bills.  he recently moved to GA to live with his parents as he is going through a divorce.  no GA's DL yet.

can i buy the gun w/o going through an ffl?

(i had a similar situation a while back with a guy here on active duty.  sorry to ask a such a similar question about residency status, but i am trying to cover my rear.)

He's established residency. You're good to go.

If he has any sort of utility bill in his name then you are good to go.  You can be a resident of more than one state, you just need to meet the ATFs little checklist.

It's a long, no residency needed.

Long guns are legally sold across state lines everyday, without FFL.

As long as he is a US citizen, there is no problem.

Nope, even long guns have to go through a FFL. A resident of another state can buy a long gun from a DEALER in another state if it's legal in his home state.

According to the op, the guy has moved here. I was referring to the 90 day residency requirement.

As long as he has Ga DL, there is no need to go through a FFL.

I understand that all firearms out of state must go through a FFL.
