HENRY COUNTY, Ga. –– A Henry County man shot two home invasion suspects Monday, fatally injuring one.
The homeowner told Henry County police that he heard loud noises as if someone was banging on his door. When he grabbed his shotgun and approached the door, it crashed open and two people began to enter his home. The homeowner said he fired once at the people and they retreated toward their vehicle. When Henry County police arrived at the home just before noon, they discovered a crowbar at the front door and the body of suspect John David Griffen, 27, of Clanton, Ala., in the front yard. Authorities said the surviving suspect, Monica Johnson Allen, 40, of Covington, had fled the scene. Just after 2 p.m. Allen called 911 from her home in Covington and reported that she had been shot. Officers responded to the location and transported Allen to Atlanta Medical Center. After being treated for non-life-threatening injuries, Allen was taken to Henry County Jail on robbery charges. http://www.wsbtv.com/news/24501634/detail.html |

when I read about the other suspect calling reporting she had been shot all I could think about was the classic "Boo got shot Boo got shot" YouTube video. link? i gues this proves a shotgun is the ultimate HD weapon? he must have racked the slide before they got the door open otherwise they would have just ran off with out BOTH getting shot. |

Good for the homeowner. I was a bit leery reading the details in the ajc article. It stated "The victim said he fired one shot at the man and woman as they ran toward their car."

Link Yeah...thats a bit concerning. I have seen homeowners jammed up good for that type of shoot. Hopefully there was an extenuating circumstance or continuing threat at the time of the shooting. Also, its Henry County, the homeowner has a fighting chance, if he were in Fulton or DeKalb County he'd be through. Hell a person who shoots a cop is entitled to a bond

Just for the sake of argument allow us to entertain the possibility that the homeowner had a reasonable belief that the assailants were returning to their vehicle in order to obtain weapons (or upgraded weapons such as long guns instead of pistols) of their own after becoming aware of an occupied home and/or armed victim. Assuming that the article is a true representation of the facts (which I do so only lightly), we have a violent entry made into the home by the assailants. The bad guys have demonstrated opportunity, capability, and intent to commit a forcible felony on the homeowner's residence. While they may or may not have intended to physically harm the homeowner I feel that their intent to inflict bodily harm on him is an irrelevant and separate issue. That is, the homeowner is justified in employing deadly force in having a reasonable belief he is in danger and having the security of his home violated. The bad guys intended to commit the burglary/robbery (as evidenced by the forcible entry into home, especially with use of crowbar which is also employable as a deadly weapon). So what I see (and am arguing perhaps just for the sake of it) are a pair of violent criminals with intent to commit a forcible felony that realize their victim is armed and that they should have brought their weapons with them... they then move to obtain the weapons they stupidly forgot/thought they wouldn't need.... homeowner has reasonable belief they still intend him harm, smokes em. Good shoot either way. I really hope the homeowner doesn't get screwed. I'm not educated on the code or case law (yet) in these regards... I see little difference between a bad guy inside/entering my home facing me or with his back to me. Inside one's home and having already demonstrated violent intent AND possessing a crowbar (deadly weapon) = Green light. I hope to God that homeowner didn't chase em down his driveway and plug em while they were running away... I'd love this to be an example to the bad guys rather than a sad story about a good guy defending himself somewhat improperly and getting hosed. edit: corrected spelling |
