Must of been a Rookie Cop. Take your drivers license to court, and it will either be reduced, or dismissed.

You didn't take note of the agency issuing the ticket.  The only ones worse than APD are Dekalb.

I have seen what Mr King suggested you do work from time to time. It really just depends on the judge and how he/she is feeling that day. What code section did they charge you with...40-5-20? Hopefully they will dismiss it for you...thats a hefty fine in our jurisdiction, and a guaranteed free ride to jail. I couldn't imagine that City of Atlanta traffic court will push the maximum for you...after all its City of Atlanta for goodness sakes...lol

Yeah its a 40 5 20 charge - I was kind to the officer and tried not to act like I had 1.5 bodies in my trunk.  If its not expensive I would rather pay it then go for court in the City of Atlanta. She said wait three weeks for it to be put into the system. What do you fellas with JDs suggest?

Depends on how much you value your time.

If you are self emp or forced to take a 1/2 day of vacation it will be cheaper to pay before the court date.

1/2 day of my time is worth more than any $50.00 to $100.00 fine.

Your mileage may vary.

Dont have a JD, but I am an LEO...I would suggest that you go to court. However, if you can find out exactly how much the fine is it may be to your benefit to just pay it off. I have seen fines range from $100 to $500 or more...just depends on the jurisdiction. Have a good chance in APD traffic court o having it dismissed or dropped down.

it should be in the system by 2-3 business days from the date of issue.
the rookie should have advised you that the court date was [21 to 28 days out] and to call the phone number on the back under the Fines section as early as 2 business days out.

check here:
www.atlantaga.gov/government/courts/onlinefinepay_031208.aspx

unfortunately, your violation is probably a mandatory court appearance at Atlanta Municipal Court (150 Garnett St):

CITATIONS REQUIRING MANDATORY COURT APPEARANCE
YOU MUST APPEAR IN COURT FOR THE FOLLOWING TYPES OF CITATIONS:
* Violations that involves Drivers License or Vehicle Tag or Insurance

get your renewed current license and do a walk-in at your convenience to the presiding court at 0800 or 1500 hours.
you will probably get it dismissed by the solicitor virtually immediately (it's just a document case.)

The lady officer told me I could just pay a fine. I plan to go get an updated license tomorrow in the afternoon. Like the other folks said if its just 50 bucks or something I may pay it instead of dealing with my boss for time off.

Does it add points to my DL, I dont think I have any now and dont want any.

PS - she did say it would be 3 weeks before the ticket was in the system.

she is only required to tell the truth when under oath.  LOL

the copy of the charge she gave you should be dated for a court date 3 to 4 weeks out.  how would it help you to wait until the court date to check it in the system?  LOL

that original pink ticket went back to the precinct at the end of the shift, was logged and signed by a supervisor, then sent on its way to Municipal Court.  it will be in the system in 2-3 days (5 at the latest).

just check it online by the citation # and get back to us, pls.

There is not a location to pay and total fee is "0" ....

Any suggestions fellas?

if you're a vet who lived in GA before your service began, you can get a free license until you're 65.

Linky to below

C. Veterans Drivers' Licenses: Issued free to veterans who were residents of Georgia at the time of enlistment or commissioning and are residents at the time of application for the license or who have been residents of Georgia for at least two years immediately preceding the date of application for the license. Individuals must have served on active duty in the armed forces of the United States or on active duty in a reserve component, including the National Guard, during wartime or any conflict when personnel were committed by the President, except for periodic transfer from reserve status to active duty status for training purposes, and who were discharged or separated under honorable conditions. The individual need not have been assigned to a unit or division which directly participated in such war or conflict. Additionally, any member or former member of the National Guard or reserve forces who has 20 or more years creditable service is entitled to a free driver's license. (For more information, see Georgia Code Section 40-5-36 here).

I was at the airport in Vegas ordering a beer.  They just instituted a policy where they have to card everyone, whether you look 21 or 121.  The guy did a triple take on the expiration date on mine.  He tried to rub the numbers off.

whether she was a rookie in field training or a 30 year veteran officer, that original pink traffic ticket leaves the control and responsibility of the police department shortly after shift.

Municipal Court controls it from then on until the final disposition.

there is no academy training on the handling of traffic citations by Municipal Court after the officer issues it.

the instructions for handling the citation are printed on the reverse side of the ticket, and supersede anything the officer said (who was not under oath at the time of issuance).

I am detecting that the "not under oath" issue has a lot of value in these instances. Meaning it doesnt matter what they said because they are not under oath. Would I be on the right track with that? I want to tell you fellas thanks btw for your advice.

most likely the first appearance date on the ticket will have been bumped forward to tomorrow because of Veteran's Day.

as far as i know that is not a fatal error on the citation, but you may call in or show up in the presiding court tomorrow as early as 0800 at 150 Garnett St.

Yeah I plan to be there bright and early tomorrow morning. There were people lined up outside a closed building today trying to figure out what to do.
