If a person is sent to state prison for 5 years on a possession of meth charge and it's her second offense what is the average stay in jail? I get the feeling it's less than the 5 sentenced.

I've known people to get out in less than a year on that. Several people as a matter of fact. Why do you ask?

Because my son's mother is in for that. It's been so peaceful with her in the lockup that I've been hoping she'll spend the entire time there.

I have full custody of him so thats not a worry at least.

I'm going to ignore the implied insult in that statement. My son was a product of a drunken night in high school. Unlike most men I've not only taken responsibility for him I've legitimized him and gotten full custody so that his life doesn't go down the same shitter as his mother.


To those with constructive posts I thank you. To the other I just won't say anything.

If a client asks I always say that "I have no control over pardons and parole, and neither does the judge. You may serve every day of five years but it isn't likely".

That being said a 2nd conviction for Violation of the Georgia Controlled Substance Act (VGCSA) - possession is defined by Parole as a Level II offense with a recommended incarceration period of 12 months to 24 months, if convicted after January 1st 2006. Where they fall in that 12-24 months is determined by their Parole Success Score Chart.


PAROLE SUCCESS SCORE
Age at 1st Commitment (26+ = 5) (22-25 = 3) (18-21 = 2) (-17= 0)
Prior Juvenile/Adult Felonies (0 = 3) (1 = 2) (2-3 = 1) (+4 = 0)
Prior Felony Incarcerations Since Age 17 (None = 2) (1 = 1) (+2 = 0)
Probation/Parole Failure (0=4) (Prob = 2) (Parole = 1) (Both = 0)
Use/Possession Heroin, Opiate, Cocaine or Methamphetamine (No = 1) (Yes = 0)
Offense Involved Burglary or Forgery (No= 2) (Yes = 0)
Fully Employed During the Six Months Prior to Current Offense (Yes = 1) (No = 0)
Writing, Reading, Arithmetic (WRAT) score of 8.0 or Higher (Yes = 2) (No = 0)


You add all that up and if their scores are between 14-20 they are considered at 12 months, from 9-13 is 18 months, and less then 13 is 24 months. But like I said, I try not to concern myself with these issues.

Thanks Dking looks like she's got at least 24 months to go. That will get him until he's 15 and she's not yet gone to court on some pending charges so I can hope it'll take even longer than that.

Sir, what would you know about class?  Your post certainly lacks it.  I take it you have never met GeorgiaBII or his son.  Both are wonderful people and both DO have class.  GeorgiaBII's son is a very respectful young man.  You could learn a lot from him.

If you can't post something nice in the Geogia Hometown Forum I'd appreciate very much that you stay out of it.  I appreciate your cooperation in this matter.

To GeorgiaBII, good to hear about full custody.  I hope she stays in long enough this time for it to do her some good.  The sad reality though is that I doubt she'll get the rehabilitation she really needs while in jail.    

I wish you and your son the best.  Hope to see you guys again soon.

My kids and I have been going down this road for a while.  They are both fine now and have productive lives.  Daughter is married to a nice man she met in church.  The both have college degrees and are working.  Son has a ME and is working in the Charlotte area.

Things that may be in your future...  

When she does get out she may use your address and phone number when acquiring credit.  As you are divorced the creditors will not come after you but the cards, letters and phone calls will come.  Most of them are reasonable when you explain the situation.

Check your credit reports.  You know what to do there.

Hope it works out as well for you and your son as it did for us.
