Good Afternoon Guys,

Thought I read a while back about joe citizen (without any CR or FFL, etc) being limited on how many guns he can sell yearly before needing a license.  I could be mistaken though.
So I was wondering if there is a limit, what it is.

You can't buy even a single gun with the intention of selling it.

You can sell off your entire thousand-gun collection, if you didn't buy them with the intention of selling them.

If you have guns you don't want any more, feel free to sell them.  You can buy a gun, try it, and sell it if you don't like it.  You can even make a profit on it.  But you can't make a living at it, and you can't buy any with the intention to sell.

I remember seeing something about that before too. I thought it was something like 50 per yr WITH the intent to sell, but I'm probably wrong...as usual.

You sure you're not thinking about automobiles???

MO came out with some new rules on that last year or the year before.  You have to have a dealer's license if you buy/sell more than X amount of vehicles in a time period.

The previous poster said it right though, buy and sell as much as you want, just as long as long as you can prove it wasn't a business.

Kinda what I was wondering guys, maybe I was thinking about something else then.  Have sold many guns this year (more or less deciding what I was wanting) and wanted to make sure in case some wierd cr@p happened that I wasn't doing anything illegal.

The 50 guns per year is urban rumor nonsense that keeps cropping back up and has been around for years.

You can buy all the guns you want.  The only issue that I see is when you buy more than one handgun in a week from a dealer they have to fill out a form and send it to the CLEO and the BATF&E.  The BATF&E is suppose to use this to help them find people buying guns to sell them like a gun runner.  

The other issue that I see is when the BATF&E does inspections of dealers they take notes on people that buy a lot of guns.  I have seen them contact a couple guys that bought a lot of guns to see what they are doing with them.  They were both collecting guns with big collections so there were not issues.

When you sell off your guns you can also have a few issues.  From what I have heard, BATF&E judges you to determine if you are dealing in firearms without a license based on your buying/selling history.  I have heard some say if you buy just one gun to sell it for a profit you are dealing in firearms without a license.  Others look for a history of buying and selling guns to make a profit.  I have not seen a magic number, I think it is up to the investigator so it could be one, ten, hundred or so on.

Never heard of that before. Bought a XD-40 and XDm-9 yesterday at Mike's and no extra forms. Bought as many as 3 handguns in one day from Mike and never had an issue.

ETA: re-read: your saying the dealer has to do something, the customer doesn't see it. (i.e. behind the sceens) . Could be, don't know, never been contacted by anyone before.

You didn't have to fill anything out, but Mike did.

If a FFL01 transfers TWO or more HANDGUNS to you in a five business day period, they have to fill out an ATF Form 3310.4.   One copy goes to the BATFE, the other to your local CLEO.  The CLEO is suppose to dispose of the record after so many months, but you know that doesn't happen.

Even if you buy one on Monday, then another the following Sunday, they still need to fill it out with BOTH s/n's.  It sucks, but it's been the law for quite some time now.

I guess I don't have to worry, since I've never made a profit off any, and always regret selling!
