I have searched the Indiana CCW laws and I cant find the exact answer to my question..Before I list my question I will give detailed information of my situation..
I have an Indiana CCW that has an expiration date of 2013 but I have moved to Montana back in January of this year..Montana law requires 6 months and a firearms course or valid permit from another state to recieve Montana CCW.  I have gone to my montana sheriffs office to apply for montana permit and as required showed him my valid Indiana CCW and he said that I dont need to apply for a Montana permit intil my Indiana permit expires because Montana recognises Indiana CCW permit..I feel there is something not correct about this issue because I seem to remember reading somewhere in Indiana requirements that you MUST be a CURRENT resident..I think I might of read something also to the effect of upon moving out of state you was supposed to notify Indiana you had left the state....Any clarification would be greatly appreciated..Thanks

My question to you is....Since I have a Indiana CCW that is not dated to expire intil 2013 and am now a montana resident (montana drivers license,address,car plates,job,etc) is my permit still valid as far as Indiana is concerned????

Thanks for all replies I have decided the best thing and legally safe thing to do is to not tell Montana I have a CCW from another state and just start from scratch in Montana.  I will have to take a class but atleast in the end I know I am 100% legal..

I highly doubt it. Your Indiana LTCH is not valid because you no longer live there, and most EVERY state that issues CCW permits require residents to have one from THAT state, not another state. If you live in Indiana, you have to have an Indiana permit, I'm sure Montana is the same way. I'd go back and insist on applying for the MT permit. If you notify Indiana State Police that you moved, it sorta puts your permit on hold, and could be reactivated if you ever moved back, but if it expires, you'd have to start over.

Definitely get the Montana permit. I'm sure they don't recognize other states permits held by THEIR residents.

OP, what about getting a Utah permit?


Montana law doesn't expressly say that a person with an out-of-state permit has to be from that state. I would think though, that the photo ID required in the law to accompany the permit must match the permit. His Indiana LTCH would not match his Montana DL.

Here's the Montana code regarding non-resident permits.

    45-8-329. Concealed weapon permits from other states recognized –– advisory council. (1) A concealed weapon permit from another state is valid in this state if:
    (a) the person issued the permit has the permit in the person's immediate possession;
    (b) the person bearing the permit is also in possession of an official photo identification of the person, whether on the permit or on other identification; and
    (c) the state that issued the permit requires a criminal records background check of permit applicants prior to issuance of a permit.
    (2) The attorney general shall develop and maintain a list of states from which permits are recognized under this section for the use by law enforcement agencies in this state.
    (3) A determination or declaration of a Montana government entity, official, or employee is not necessary to the existence and exercise of the privilege granted by this section.
    (4) The governor shall establish a council, composed of interested persons, including law enforcement personnel and gun owners, to advise the governor on and pursue concealed weapon permit issues.

He MAY be able to get a Utah permit, but I don't see why he wouldn't get a Montana permit? I would look at usacarry.com's page on permit reciprocity and see what states recognize Montana's permit, and what states recognize Utah's non-res permit, and based on OP's most likely travel, choose the permit that suits him.

I would also contact the Montana Attorney General's office and find out if it's OK for a Montana resident to carry in Montana on another state's permit. Here in Indiana, Indiana residents MUST have an Indiana license in order to carry in Indiana.

You must also notify ISP if you change addresses.  Since Indiana does not issue out of state licenses, once your address is out of state, you are no longer a resident.

Either get the Montana license or one from a state that does issue out of state licenses.
