| A family member in MD has asked that I help with a kit build by having the parts shipped to him and then put it together while out there this summer (I understand the lower receiver will need to go to a MD FFL). It seems like I read some time ago that MD only allows HBAR's? anything else that is reg'ed out there? Any reason he can't have a complete 16" light weight barrel A3 (with m4 type stock and threaded FH) if I bring it with me complete and just give it to 'em? Thanks a bunch in advance! |

No reason at all why he can't build the rifle however he wants. As long as the purchase of the lower is done in compliance with the law, he's good to go.
The HBAR exception is one of those weird hypocrisies in MD law. According to the law, a Colt HBAR is a non-regulated firearm (cash and carry, same day sale from an FFL with a NICS or is a permissible FTF sale). Other ARs are treated as handguns (extra MD form, waiting period). It has become common for most FFLs in MD to treat any HBAR as a non-regulated firearm. Apparently an HBAR isn't as dangerous as a carbine
So, he gets the lower shipped to his FFL and does the paperwork early enough for it to be ready to be picked up by the time you get here. Order the parts and build to your heart's delight. |

You can send the upper in the mail if you want to. Assault pistols (Tec-9s and the like) are banned but everything else is good to go, including all Class III firearms. |

You can ship the lower to yourself too. Do it a week or so before you leave. |

That's the way I understand it. Was there NOT a big confusion about the HBAR exception a short while ago, the state police were telling anyone that any brand HBAR fell under this, and then the attorney general came back and said, NO, its only COLT HBAR's that are non-regulated firearms, leaving a lot of people in legal jeopardy because of the previous interpretation. Thus, the FFL's now just play it safe and treat all HBAR's as regulated firearms. |
