If I had one like that, I would form 1 it and leave it like it is (add an optic or sights of course) and watch people lose their minds when I shoulder it at the range. The entertainment would be worth the $200 tax.

It wouldn't make a difference without the form 1. Shouldering it doesn't turn it into a SBR and there's no law against using an accessory for an unintended purpose.
You would be better off putting $200 on a target and blowing holes in it if you want them to lose their mind.

Not according to the BATFE's latest letter, which rescinds all previous letters. They're doing it for the children.

Ugh the last one I saw was in December. Oh well, it's a good thing ATF agents aren't sitting at ranges waiting for someone to shoulder their pistol.
Either way ATF letters are merely an opinion on the law and until they have their own secret courts with kangaroo judges they can't just make up judgements on a whim. We'll see what happens if/when they finally charge someone and and appellate courts decide.

As much as people bitch about the ATF, I'm surprised they even attempt to be transparent and give their legal opinions. Ask any other law enforcement agency and they'll tell you to consult with a lawyer.
