Just throwing this around before I check with local PD tomorrow. I'm looking at purchasing a house with 5 acres of land. At the very back of the land is a small creek with about a 10-15' berm across from me. There are no house in that direction on the higher land where the berm is. I think the area is considered "city" limits in Newcastle. Before I purchase I'm wondering if it is illegal if I were to shoot at the berm? The land slopes down from the house roughly 3 acres to the berm. Anyone know if I will be able to do it this or if I will be ,SOL???  Thanks for any advice you can give. Jace

From the Newcastle ordinances:

§ 132.02  DISCHARGING FIREARMS.
It shall be unlawful for any person to discharge a firearm within the corporate limits of the city, except when doing so in the line of duty, when lawfully doing so in defense of oneself or of another person or property, when otherwise authorized by state law or ordinance, when doing so for the preservation of the peace, health or safety of residents or the abatement of nuisances, or when engaged in authorized hunting or other related activities.  It shall also be unlawful to discharge an air rifle or BB gun within the city in a manner as to harm or damage persons or property.

§ 10.99  PENALTY.
  (A)   Except as otherwise provided by state law, whenever in this code or in any ordinance of the city an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or whenever in the code or an ordinance the doing of any act is required or the failure to do any act is declared to be unlawful, where no specific penalty is provided therefor, the violation of any provision of this code or of any ordinance, upon conviction, shall be punished by a fine of not exceeding $200, excluding costs.  Each day or any portion of a day during which any violation of this code or of any ordinance shall continue shall constitute a separate offense.

Yup, you could have a full fledged certified shooting range in your backyard but as long as you are in city limits it will be 100% illegal to shoot there.  Living in the city limits of every place I've ever lived had the same law, best to always buy/build in the county.
