Anyone familar with this business? They were mislead by a local gun store in CT that grease gun wasn't legal.
Unfortunately, not all gun stores in CT are knowledgable with what's legal or not. I'm trying to tell them what is on the ban in CT. Besides, a FFL dealer will not accept an illegal weapon on their books, knowing the penalties and possible revocation of their license. Finally when a transfer is done, authorization and copy of transfer paperwork goes to CT State Weapons Unit. Therefore, there is a papertrail and checks/balance. |
| the seller at pawn shop received wrong info from a knucklehead local gun store in CT claiming that the grease gun wasn't legal in CT. I didn't know if anyone is familar with the shop that could tell me if I was wasting my time trying to convince seller that it was legal to own. Kinda hard when you have to try to get them when they are at work or wait til they respond to email. |

The receiving FFL should probably be the one getting it straight. It will hold alot more sway than some "gunshow lawyer" on the internet, especially after an FFL (who's supposed to be the expert) in CT told them it was illegal.
I realize you probably know more about you gunlaws than many of the FFLs there, but you might not. All that the pawn shop here knows is that a CT dealer, licensed and inspected by the Feds and State has told him it's illegal. I think having the receiving FFL explain the law to them would be the most effective thing. |

Unfortunately, I advised him that I have 3 FFLs that is willing to transfer it and speak to him about it. A FFL in CT I imagine is like any FFL in other states, they are not going to risk losing their license/fine to transfer an illegal weapon into their books. I have a FFL that is an active LEO, a retired LEO and the third was instrumental in allowing CT residents to own AK47 other than 7.62x39 caliber such as .223/5.56, .308,5.45x39 so he is very familar with CT AWB.
I even offered to contact State Police Weapons Unit for approval but seller said because it "looks" like an assault weapon, he doesn't want to risk it. How is he "risking" it? After SPWU gives authorization number for transfer, a copy of the transfer paperwork is filed with local and state PD's. Then there is the matter that "what if it gets stolen?" Well, what if ANY weapon is stolen?. AR15, FAL, Mini-14/30.& etc. A Bushmaster AR15 w/out bayonet lug,flashhider and fixed open stock looks like an "assault" weapon too but it's legal in CT so are FAL "clones" HK "clones. As for internet lawyer I'm not, but I do know more about CT AWB than a good amount of FFL gun store owners in CT. When I 1st started collecting, I was told by a store owner FFL that has been in the business for years that "ALL" prebans were illegal which is untrue. It's just disappointing that the seller is not willing to sell a legal weapon because of the way it "Looks".

| Go ahead and have one of the FFLs that is willing to transfer it send the paperwork to VB pawn shop. Have them write a nice letter explaining the law and cite local laws and ATF requirements as needed. If the guy is looking for an get out of jail or CYA letter, ok, give it to him. Have your FFL contact him and get the name of the FFL he spoke to and worse case call the one in error and have a conversation about what's legal in your state and then have the other FFL call up the VB beach guy and clean up his mess. |
| FFL license & payment was already sent. The CYA attempt, was covered when I asked whether he needed confirmation from State Police Weapons Unit and he rejected it saying it was his "decision". I just called two gun stores in CT(supposibly very knowledgable with Assault type weapons) and one said "illegal" claiming that it's listed on the ban list ,which it isn't and the 2nd never heard of a grease gun but at least is willing to check on it. Unbelievable! Both stores has .223/.308 ARs, MSAR STG 556,P90, Ban version of Sig 556, & AK's not in 7.62x39 cal but oblivious to a grease gun. I gotta move |

With the lawsuits, etc. from NY and various powers that be in the Northeast trying to set-up VA FFL's to make a name for themselves, there's little incentive for him to deal with this mess. He's been told by an FFL in CT that it's illegal and there's no reason to fall for a "sting" operation telling him it's not. He'll sell it easy enough to someone who can legally own it (Yeah, I know you legally can, but not in his eyes).
With all the NY state BS lawsuits and what it cost FFL's that they screwed with, you can't blame him too much for not messing with it. How did the "knucklehead FFL" that gave him the wrong info get invovled in this in the first place? |
| I call after not receiving confirmation that payment and FFL paperwork was received and was told that seller thought it was illegal in New Hampshire or CT so he was checking. I sent additional emails explaining why it's legal which went unanswered. I called again and seller told me that he called a local gun store who told him it was illegal. I understand his concern about "Stings" but if he truely wanted to sell at my bidding price then all he had to do was call the weapons unit in the state(go directly to the source). |
