Hello Guys
I have just escaped the INSANITY that is New York City and I plan on buying at least three sbr's and a few suppressors. I was wondering if you guys could recommend an NFA Trust Attorney so I could set up a trust. I live in NoVa, so I may have ass pain from the Chief LEO so I thought a trust would solve that for me. This is why The ATF approved the transfer for the M11/can to the trust, then went after the guy for the F1. I think its a safe assumption that the person in question changed something about the trust in between the first and second transfers that invalidated it. If your going to skip the lawyer and use Quicken Willmaker, at least leave the final product the same. I would definitely like to know more details about this case. |

The ATF approved the transfer for the M11/can to the trust, then went after the guy for the F1. I think its a safe assumption that the person in question changed something about the trust in between the first and second transfers that invalidated it. Why do you think it's a safe assumption? My guess is that ATF simply missed the problem the first time, or nobody there reviewed it carefully, and this person just got away with it on the first transfer. |

He does a lot of trusts and knows all about it. He will go over everything and then have a draft of the trust to you in PDF format for review. Once you agree to any changes you are good to go. |

I know Fairfax signs but they are saying they need 3 to 4 weeks before they return my paperwork to me. They also want to know about my home security and such which I have no problems talking to them face to face, so I know who gets this info, but dropping the paperwork and trusting it makes it to the right person before somebody sees it that I don't want seeing it is another thing. I don't like writing down weapon types, address, and type of security that will sit around a jail for 3 weeks. Who knows where and who can look over these forms during that time. I'm thinking of doing the trust thing now because of this over long and not needed wait time. Plus I have to wait 3-4 weeks every time I do one. Maybe I should just make a call tomorrow to a lawyer and cut out the local CLEO thing all together. Does anybody know how much lawyers will charge to just review a NFA trust to make sure there are no issues?

However, my membership does expire this month, so . . . hint, hint NOT a crappy WillMaker version, but handcrafted by me at great time and expense. I don't want to advertise for any particular lawyer in Virginia, but using an office supply store trust, or a trust off this forum prepared by a non-lawyer seems RISKY. Given the differences in state laws, as well as the NFA requirements that may not matter at the creation of a trust –– but can surface later, its asking for trouble to use an amateur trust.
Besides getting a trust that is proven to be "right" under the laws of Virginia and the regulations of the ATF, a skilled trust lawyer 1/ gets you up to speed on the use of the trust, 2/ advises on decisions such as bank accounts and storage issues, and 3/ is available for transaction questions later on. The $500 for a professional trust and these related services seems about right, particularly compared to some non-NFA lawyers accustomed to charging $1000 or more for a routine revocable trust. (Did someone post a lawyer that wanted $1500??!!) There is a peace of mind factor in knowing that you have professional work done. Of course, some people would buy a "Do it yourself home dentistry" kit. Just one lawyers thoughts.... |
