hello fellow virginians. i thought i'd stop by the hometown forums to get some advice on do's and don'ts while ccwing through your fine states. ohio has reciprocity with both states, so i thought i'd ccw while on my way to NC for a family vacation. i know every state has different laws, and i know that i cant claim ignorance to each states law's. for example, in ohio, if stopped by LE we MUST notify we're carrying. what are the requirements for WV and VA? do's and dont's? i know i could check out each states AG website, but i figured i'd get some friendly advice from arfcom. what say ye? |
dunno about wv, but there is no duty to notify in va, but, why the hell wouldnt you? |

VCDL has a good page most prohibited places in VA: www.vcdl.org/static/ccw.html You aren't required to notify police when stopped. Some do out of courtesy, but it isn't required. It is a personal call. Biggest advice: Watch your speed in VA. They like to back door tax everyone through ticketing. The biggest "thing" to worry about is going to eat at places that serve alcohol, you must open carry, concealed is illegal (thanks to our shit head governor). Enjoy the drive through. |
Unless they ask you to leave! But I live in liberal northern va and YET have had that to happen. OC is 110% legal (sans places which it is prohibited by law of course). Pretty much, if you are going to stop somewhere to eat, OC in VA. 99% of places which sell food (besides McD's) will be serving alcohol. |
You can not conceal in a place that sells alcohol for onsite consumption. If you wanted to stop off at the local grocery store or liquor store and buy some alcohol, you would be fine for conceal carrying since these places do not have onsite consumption licenses. |

In WV, you do NOT have to notify if pulled over, but, like other mentioned... it is a courtesy. There is NO restrictions on CC other than the standard Federal fare... As far as restaurants/taverns/bars go... "Legally" you could be three sheets into the wind pounding down Budweiser, chasing it with Jack Daniels at the bar while carrying. Probably not too smart.... |

i don't really plan on purposely carrying into a liquor establishment, we will be spending most of the time with family etc. i'm kind of shocked it's legal. in ohio, carrying while intoxicated is considered "weapons under disability" a felony iirc. and i can't say i disagree with the law, either. |
Well, there is a big difference between carrying and being trashed and having a glass of wine with dinner. I wouldn't recommend drinking while carrying, but a glass of wine won't kill you. VA statues only cover being drunk while CC'ing (as I recall). But if you get into a shooting while you have alcohol in your system, it is bad news for you legally (tort). |
