It's funny i've been doing this for over 10 years. You would think I would remember. anyways..
I drove over to the my FFL dealer today to fill out paperwork on a buckmark i'm getting. It's a 72 hour wait from 1pm the on the 21st. So does that mean I can pick it up today at 1 pm on the 23rd ? I don't think I've bought a pistol in 2 years. that's why i can't recall. Another thing is I don't remember being able to fill out paperwork before the weapon got into the gun dealers hand before. Is it legal to fill out a 4473 before the weapon is actually in the dealers hand? I keep arguing with my self if it is or isn't. |
| From what I understand most FFLS will let you start your paperwork and call in for your background as soon as you place your order, effectively starting your wait period whilst the firearm is in transit. It is such a common practice I have a hard time believing it doesn't fall in line with the law. And the other response was correct, if you did your paper work and you FFL called it in at 1300 on the 21st you'll have to wait till 1300 on the 24th. |

There is no requirement that the gun be physically present at the point of sale to begin the waiting period. The language only says you have to wait 72 hours after "application for purchase", usually the time you're filling out the 4473.
(720 ILCS 5/24-3)
Sec. 24-3. Unlawful Sale of Firearms. (A) (g) Delivers any firearm of a size which may be concealed upon the person, incidental to a sale, without withholding delivery of such firearm for at least 72 hours after application for its purchase has been made, or delivers any rifle, shotgun or other long gun, or a stun gun or taser, incidental to a sale, without withholding delivery of such rifle, shotgun or other long gun, or a stun gun or taser for at least 24 hours after application for its purchase has been made Illinois Compiled Statutes Link My FFL will typically begin the wait when I order, and call then as well. AFAIK the call in can be done any time before the sale, as long as the sale (transfer) is completed within 30 days. I suppose they could start the wait when you order, pay, and fill out the "top" of the 4473 on the 1st, the gun arrives on the 5th (thus meeting the 72 hour wait), they could call in when you come in to sign the 4473 and pick up the gun on the 6th and have met all the regulatory requirements - as long as you're approved, of course.
The time of the call to ISP and the 72 hour waiting period are unrelated, except for both being required by our benevolent overlords.
