Has anyone heard of a thing called Home Rule?
The reason I'm asking is that according to the NLV. Code Nazi's, er, I mean Code Enforcment, They can come on your property at any time they want! I have a small trailer that I am Fixing up in my driveway and the fenders are off and in the back of it. He wanted to see the Plate for it and as I was going to get it I asked him that if I showed it to him, was he going to ticket me for something else? (Thats something that they always do) He said Yes!!! I told him that I would not show him the plate, and that if he came on to my Property I would file Trespassing charges on him. Thats when he said that because of "The Home Rule", There was nothing that I could do to stop him! I asked him where I would find that Law, and he said, "Look it up"! So I did, and it only applies to Trailer Parks. I went back out, told him what I found, and again asked him where I would find it. Then the Asshole called me a Militant! Say What!!! Was I supposed to give him Money, invite him in for Dinner, Maybe get a little from the Old Lady! WTF! Then he rolled his window up on me! |

Now, LE has the ability to enter a property, without a warrant, to investigate. I have never heard of the "Home Rule" as it pertains to code enforcement. There is a legal definition on one site, but it says NV is a Dillon rule state and not a Home Rule. This has more to do with restricting/defining powers of local govt.
No Trespassing signs don't really apply as they are there for a lawful purpose. Was the area locked or fully gated? That has been an argument in some cases and I only know of one where it was an issue the court granted. There are some codes/ordinances on the books mandating that each vehicle be operable, which may include registration. Some of the code/parking enforcement guys are Nazis. I have nothing but trouble with CLV parking. They have cited 2 of my marked vehicles, my unmarked vehicle twice, and threatened to tow my unmarked car when I was on a stop. |

I have a piece of land up in UT and put a set of these signs up near my gate.
A much different situation, but I am told that they will keep Building Inspectors out and the like, because they would have no cause to enter your private property. I may be off base here, but none the less, by they time they finish reading these signs, they may be too tired to proceed, or think you are a nut case and think twice about entering and or finding out what other parts of the Constitution that you may choose to uphold (2A). I have no Idea where they get these people, but if it were not for fines that I am facing, $1132.00, They would be entertaining!
A few years ago I was cited for my trees growing into the Powerlines. There are no powerlines on my side of the block! I guess If I started acting like a Zombie, I could get a very well paying Job with lots of benifits in Nofe Town! 3rd grade education only required! Just pretend that you know what your doing, and if they resist, call them Militant! Damn, labeled again! The Government is making the word "home" sound like a bad word. |

Maybe he brought that term with him from the "Love State". Maybe he thinks that the saying, "Me Casa is you Casa" Is a legal term? Where do I start to look up Home rule and Dillon state rules? When I put up the No Trespass signs years ago I had unexpected consiquences! The Post Office refused to deliver Mail to me because my Mailbox was on my house! I had to put it on a post at the front of the yard. I explained to him that LE could Enter in some cases if they felt a crime was being committed, but that He was not LE! They are even still useing NLV Fire Department letterheads. I filed a Trespassing report on a Code Nazi a few years ago, and it got shuffled under the table. When I brought it up in Court, The Judge was Pissed, and the Prosecuter about pissed! Apparently I was the only one that had a Report! NLV does have have them Ordinances. I was going to show him the Plate until he said that he was going to Cite me for other things afterwards. |
