Heard this 2nd-hand but it's from a very reliable source.

Friend of a co-worker has a son that has a nice classic GTO.  The "boy" and his dad had parked in an Albertsons parking lot somewhere in the eastern 1/2 of the vegas valley.  Dad has a CCW.  Son was walking across the parking lot and was approached by a couple of hispanic men whom asked him to "take us for a ride in your car".  Boy responds "I'm not going your way" at which point they state they're going to take the car.  At this point boy turns back toward dad who was carrying a box a few feet behind the son (bad guys prolly didn't realize they were together) and says real loud "you're not getting my car".  Dad realizes what's going down, drops the box he was carrying, and draws down.  Dad then demands their wallets, takes their I.D.s out, pockets them, and then throws their wallets up on the roof of the Albertsons. Old ornery dad dares them to call the cops on him, they split.

Ok, I wouldn't have handled it this way, I would've called the po po and hoped to get them busted for car jacking but I do find it funny/satisfying that a couple of dirt bags got the tables turned on them by a CCW holder (and an older guy at that).

Yeah this should have been reported. .This taught those guys a valuable lesson for the next car jacking they do. Thats to bring a big gun along. I almost got jacked by two latin guys on Trop and Koval a few years back. 2 latin dudes with a old BMW 325 with steel bumpers rammed me and ordered me out. I didnt and then decided it wasnt cool to continue and left. I just remembered the guy had a lot of pock marks on his face. Little did he know I had a pistol pointed at him behind my door. i reported this one of course. Bent my bumper upward when they rammed me.

I'm glad all turned out well, but I wouldn't suggest countering an attempted robbery with a robbery.

ROBBERY

     NRS 200.380  Definition; penalty.

     1.  Robbery is the unlawful taking of personal property from the person of another, or in his presence, against his will, by means of force or violence or fear of injury, immediate or future, to his person or property, or the person or property of a member of his family, or of anyone in his company at the time of the robbery.

it's probably best that the Police didn't get called on this one.

I see this being a robbery by the letter of the law but if he took their IDs and gave back their wallets then immediately called the police and turned them over would he likely be charged?

As to what I'm reading from the original post, he used his firearm to take their wallets/ID's.... he didn't use the firearm to defend himself in the latter.  He went from the defensive to the offensive.  As to if he will be be charged, I believe that will left up to the responding officer and the DA's office.

If he called the cops and the ID taking was to secure their identities in case they ran, then he would be fine.

As with any internet story pertinent facts are missing.

Ok cool, because that seems like an excellent idea as long as it is legal.

I had about the same thing happen to me around 15 years ago.
My Dad had a mine just out of town and was in the process of moving out.
I had went up to pick up some more stuff and came up on 2 guys and 2 girls breaking in to his place. They had been on the other side of the mine shooting before they decided to beake in, so I knew that one of them had a gun.
The sun had gone down, and when I drew down on them I could only see the outlines of there upper bodys, so to be safe I told one of the girls to get everyones IDs and drop them half way between them and myself and leave, and that Metro would be contacting them.
By the time I got to a phone they had beat me to calling and said that I had robbed them! Metro took my gun and said that I was going to be brought up on charges of armed robbery! After a few weeks I called up and asked them what was going on and why they were not being arrested for burglery! They said that the charges were being changed to Kidnapping, and that I would have to wait for the DA to figure it out!
2 or 3 weeks later I called back and they said that the charges were going to be Coercion! Thats when I cut loose and told them to go ahead and file against me, and that I was going to get an Attorney and go after them!
It turned out that one of the bad guys Dad was a metro Cop, and was trying to bluff me out!
We, came to an understanding and everything was dropped

I can't quote Mr. Rogers accurately and correct me if I am wrong, but I think it was more like "They're going to meeting with some lead."

Somewhere there is a video of Mr. Rogers making that statement.

Be Safe.

Personally, I wouldn't want to bother gathering IDs.  I'd want to be 100% focused on watching the bad guys and making sure none of them made a move for a weapon or have buddies coming from elsewhere--maybe they watch too much TV and think they can make a Bruce Lee move and shoot/stab me before I can shoot them.

Props to "Dad" for not being a victim (or allowing his son to be one).

That's a good question, I'll have to see if I can find out more details. Unfortunately, I don't personally know the subjects of the story so all I got so far was from a casual friend at work.

Here's my question...is your ID your property? Technically, your credit card isn't, it's property of the bank. Is your DL property of the State of Nevada?
5/4/2008 9:36:06 AM EDT
[#22]
Yes, the credit card and ID are BOTH your property.

Is your name not on both? You are the legal owner of both.

Anything you possess or are legally in control of becomes your property, when it relates to criminal activities.
