Wow, was it he said/ she said or was there actual evidence or witnesses? Never heard of this one. Evidence is pretty much just the surviving guy’s testimony and the physical evidence from the scene. Do a search on wikipedia and they have links there to the criminal complaint which will give you lots of details. Don't have much confidence in the accuracy of the wiki page based on the first paragraph, however. |

I find it interesting that he was shooting 9 Ultra out of a 9x18 Makarov with a smooth bore barrel. Because of the smooth bore and the smaller diameter bullet, the firearm’s expert wasn’t able to conclusively match the recovered bullets to Jesus’ gun. Which makes one think. Other than the seemingly nefarious intent of making the bullets from your gun untraceable, is they any valid defensible reason why one would want to do that?

WTF? aside from questionable motivation, sounds like it could be an NFA issue too. Special barrel or did someone modify it? Gonzalez mades some unforturnate choices and did a dis-service to the OC/CCW community. |

My guess is a person that doesn't know the difference, assumed it was a smooth bore. My guess would be, either A: Gonzalez knew this, and intentionally did it. Or B: assumed that 9x18 = 9x18, and just ignored the ultra/makarov disclaimer. |

Or B: assumed that 9x18 = 9x18, and just ignored the ultra/makarov disclaimer. The firearm 'expert' from the State Crime Lab examined Jesus' CZ model M82 and made the smooth bore observation. He mentioned "...none of the bullets had rifling indicating they were fired in a smooth bore barrel, like the barrel of the CZ firearm". My first impression too was this is veering into NFA terrirory. Isn't this why Taurus put some token rifling in the barrel of the Judge? That would be a federal crime then and I'm sure considering the DA had a slam dunk of a homicide case that probably took priority. If this could be an NFA issue, I suppose federal prosecutors can pursue their own charges at their leisure. Mr. Gonzalez isn't going anywhere for a while. |

A CZ-82 does not have a true smooth bore. It has polygonal rifling which looks smooth at a casual glance. I am willing to bet that he did not deliberately use the 9mm Ultra rounds and simply bought and used them by mistake.
