I will be staying in WI right on the boarder of the twin cities for a while. So I need to know some stuff. What are the details of AR ownership, or in general, bringing my guns into WI? In regards to travel in a vehicle... Can the firearm be in the glove box? Cased? Holstered? Magazine loaded but not inserted? Magazine loaded but separated? What is loaded? I will probably put the AR and others in my pickup bed (shell), but can they be loaded? My AR cases have mag pouches, so I would like to not have to unloaded all those mags if I can avoid it lol. |
|
Thanks. So to clarify.... Loaded AR mags in mag pouches that are part of the AR case are not considered loaded? How about loaded mags inside the case with the firearm, but not inserted? I can have my firearms in cases anywhere in the cab? What about if I do not have a case for a couple of the rifles, and only a holster for one of the pistols? |

Right, not in the firearm means the firearm is unloaded. No round in the chamber. I can have my firearms in cases anywhere in the cab? Its best to be the furthest from you, back seat ect. What about if I do not have a case for a couple of the rifles, and only a holster for one of the pistols? All firearms must be fully cased to travel in WI. Holsters dont matter, just has to be in a case. |

That isn't concealed? Can I use a backpack if I have other stuff in there too? Does it even need a holster if in a gym bag? |

Hold on a second now... That isn't concealed? Can I use a backpack?Does it even need a holster if in a bag? As long as everything is unloaded and in a case its ok. Concealed would have to mean its uncased and hidden (like in a glove box/center counsel). I'm sure a local LEO will be along shortly to better describe the laws. I have a range bag that looks a lot like a gym bag with dividers, works great for pistols/mags. It doesn't matter if its in a holster or not if its fully cased. The general rule it fully cased and unloaded= you are good to go. |

As long as everything is unloaded and in a case its ok. Concealed would have to mean its uncased and hidden (like in a glove box/center counsel). . Concealed has nothing to do with a case. Safe transportation and CCW are 2 seperate statutes in different sections. You can comply with the CCW and be in violation of the safe transportation statute or you can comply with the safe stransportation statute and have a concealed weapon. A person transporting a firearm is governed by both statutes. To comply with § 167.31, the person must encase the weapon. To comply with § 941.23, he or she must place the enclosed weapon out of reach. Complying with WIS. STAT. § 167.31 is not a defense for a concealed carry violation. In a case on the seat next to you is "concealed". In the glove box (or center console) even though it is in a case is still concealed see State vs Alloy. A gym bag is NOT a "legal" case. Encased is defined as: "Encased" means enclosed in a case that is expressly made for the purpose of containing a firearm and that is completely zipped, snapped, buckled, tied or otherwise fastened with no part of the firearm exposed. |

So what about in a case behind the seat of a standard cab pickup? I only have that and the bed, and the bed is not really great if I have to go into a store or anything. I knew Wisconsin was restrictive. I take back my, "its not as bad as I thought statement". |

I do not know of anyone being charged for a concealed long gun because of it being behind the seat of their truck. It is what most of us do. Place the handgun along with your long gun in one of the long gun cases. Getting a long gun case from behind the seat would be a neat trick while sitting in the seat. The reality is that you would have to really screw up for someone to search your vehicle..... |

Training I received at my recruit regarding this standard is that behind the seat of a pickup truck is acceptable to be considered out of reach, as behind in the bed isn't considered secured and there is no trunk.
I'm from that section originally, so email me if you need anything. |

If it's unloaded and cased you can put it anywhere you want it and you won't have an issue. |
