The illegal "Late Fees" imposed by the CO DOR/DMV for expired plates/registration may be going away. The fees are absurd. If you have a vehicle and the plates expire you have to pay arrears to the date it expired AND a $25/month or $100 max fee on top of that.
I have a spare vehicle that is used for my camper and it has out of state expired plates. It's been in storage. Since when can they impose a late fee for something that you aren't required to have. A vehicle can be stored unregistered on private property. How can they impose a late fee for something not required? **"House Bill 1084 makes the late fee $10, to be imposed at the discretion of the county clerk, which is the system Colorado had before 2009. That year, Democrats passed the transportation measure FASTER, which in part raised late fees to $25 a month — capped at $100 total — and made them mandatory."** Short Article -JC |

Good news! They were absurd––they always made you pay the back taxes anyway, so there was no advantage to paying late.
I believe the reason they can collect back taxes is because these are ownership taxes which apply to a vehicle in the state whether you drive it or not. But I could be mistaken on this. I once had a lot of help in this department because I had garaged my bike for two years after moving back into the state. When I went to register it, I had some paperwork to fill out to avoid paying four years in back ownership taxes. The gal at the DMV "helped" |
