Does anyone know: Is an AR-15 considered a rifle or pistol in Washington State (I have heard that it is a pistol since it has a pistol grip. Sounds crazy, but I just want to make sure.)? And if an AR-15 is a rifle, what are the laws for transfer of ownership? |

An AR-15 is considered a rifle in ALL states if it has a barrel that is 16" or longer and a stock of some sort. An AR-15 is considered a pistol when it has NO STOCK and a short barrel. If a stock is attached to a short barrelled AR-15 then it has been made into a SBR (short barrelled rifle), which is illegal without going through the proper federal channels and paying for a tax stamp ($200).
In WA State AR-15's are legal, and there are no restrictions as to capacity as there are in some other states (think CA). You are NOT required to register firearms in WA state, and private party transfeers are legal and need not be documented with the state. That's as bad as the gun store employee that told me, with a straight face, the 460 Weatherby Magnum was "sixty caliber."

Now, I wonder if that answers my question. My main concern, being new to Washington state and damm proud that I moved to this wonderful neck o the woods, is a scenario like what happened in Hurricane Katrina. National Guard was banging on the door of any registered firearm owner and telling them to hand over their weapons. With all the talk of HINI quarantine, I am wondering if some day there might be a nice man at my door asking me to give up my possessions. Is this a question for the second amendment forum? I recall seeing the "pistol grip" theory on a forum somewhere and wanted to make sure it wasn't some loop hole in the law to keep such an exquisite rifle from the common patriots hands. It sounded ludicrous to me as well, but you never know with the law.... Thanks to all with helpful replies! |

If you think controlling powers are %100 truthfull and trustworthy then you are merely living in the bubble of prosperity that this country was lucky enough to fall into. I'm no wacko. Just looking out for my rights. If you don't, somebody bigger with more money will come along and take them away from you...
