I do not understand your last, did you get robbed or only warned ? Robbed. Pretty steep revenue collection in the name of raising public awareness, IMO. Especially since I'm an adult and would have understood a verbal caution. Now I'm getting more pissed about it... |

RCW 46.61.200
Stop intersections other than arterial may be designated. In addition to the points of intersection of any public highway with any arterial public highway that is constituted by law or by any proper authorities of this state or any city or town of this state, the state department of transportation with respect to state highways, and the proper authorities with respect to any other public highways, have the power to determine and designate any particular intersection, or any particular highways, roads, or streets or portions thereof, at any intersection with which vehicles shall be required to stop before entering such intersection. Upon the determination and designation of such points at which vehicles will be required to come to a stop before entering the intersection, the proper authorities so determining and designating shall cause to be posted and maintained proper signs of the standard design adopted by the state department of transportation indicating that the intersection has been so determined and designated and that vehicles entering it are required to stop. It is unlawful for any person operating any vehicle when entering any intersection determined, designated, and bearing the required sign to fail and neglect to bring the vehicle to a complete stop before entering the intersection. So.... where does it say anything about stopping at a non-intersection? Did you hand the guy a check, or do you have to take a ticket down to the county? |

He said something about responding within 14 days, but I wasn't really listening to him much at that point. (Pretty sure he knew what I thought about it all. We went from friendly to not, just as soon as he showed me the price tag. Like I say, he apologized twice) Quoted:

I hate to say this but stopping on railroad tracks ain't real smart or legal.
Saw a guy in Seattle (2nd and Lander) pull around the RR barricades two days ago and miss the train by 4 seconds. I wish he would have gotten the ticket instead of you but.................. |

(the 'getting caught' to 'getting away with it' ratio, previously made me fairly comfortable with just paying the ticket. pretty sure I'm still ahead on that one) This time, it bothers me. |

He could have handled it differently, or more appropriately, IMO. (not blaming him specifically. he could be under pressure from his superiors for all I know. I understand, but do not agree with the consequence. They don't need my money with bailouts growing on trees these days) |

Yeah, honestly, this kinda stuff is just revenue generation. I mean he can look at you, see you're a decent-looking person, decent-looking car, polite, minding your own business...........................not like you're some damn tweaker sitting idly on the tracks pickin' at yer sores..................
A warning shouldv'e sufficed. But as you said, just doin' his job, probably is pressure about these things. |

The revenue generation is only going to get worse as the state heads towards bankruptcy. I heard on the radio that State Troopers were dressed like panhandlers to check drivers for seat belt compliance at intersections. The slippery slope is getting shorter. |

Yes, I verified there were no trains coming before occupying their space Did you call the train dispatcher or something? No curves in the track or objects obstructing vision? How far away can you see an Amtrak coming at 79mph? What crossing was this? Sorry, but I have personally witnessed so much poor judgement used at rail crossings and had so many close calls that I am initially much more likely to side with the officer in these cases. And this sort of enforcement is nothing new. |

You don't need to be a dickhead about it No curves in the track or objects obstructing vision? Not enough to concern me How far away can you see an Amtrak coming at 79mph? Exactly as far as anyone with 20/13 vision can. (had 'em checked last year) What crossing was this? Main Street, Chehalis, WA Sorry, but I have personally witnessed so much poor judgement used at rail crossings and had so many close calls that I am initially much more likely to side with the officer in these cases. I assumed you would chime in with something like this, and I respect that point of view. Hopefully you can respect mine. I didn't expect the smartassed parts though And this sort of enforcement is nothing new. Never thought it was, but it is new to me at this level. If you've read my other posts, you will notice that I'm not blaming anyone for anything. My mistake for sure. However, taking that much cash out of this familys budget over such a tiny oversight, at this time of year, is enough to bother me. So I think I'll fight it. I'll let you know how it works out. What bothers me slightly more, is the assumption that I may need to be educated on train awareness. And if so, where is this new information at? Tell me if I've got this straight. If I recall correctly, trains run down the tracks, not across them. They weigh enough to destroy most anything they collide with... weight x velocity and all that jazz. The mess a collision can create can be tragic and huge, including loss of life and property, injuries and delays in freight or passenger arrivals. People who are at blame for any train collisions are morons, and they deserve whatever happens to them. Granted I've only been driving vehicles across train tracks for about 30 years without incident, I'm sure there is much more to learn on the subject. <sigh> |

That's one way to view it I suppose. My opinion has always been that anyone interested in ultra defining the CoC, probably wont accept the answers regardless of where the limits are anyhow. Good luck with your quest for justice though. |

So, just to summarize:
* OdT get stuck on the tracks * Sherrif is sitting on his ass watching said tracks 'cause its easier than catching speeders, illegals or meth-heads * Writes OdT a ticket for $124 instead of giving him a lecture on the dangers of fast moving trains t-boning little trucks * Sherrif writes wrong RCW on ticket * WAHTF melts down again... I'd take it court, claim you didn't do it (or whatever they put on it these days). Don't just plead your case in front of a Magistrate, they will still nail you for court costs. Buy Phil a beer. I'm pretty paranoid about getting stopped on the tracks and it still happens to me sometimes, it will look like traffic is flowing just fine and then it all stops suddenly. |
