Alrighty, so last July i was involved in an accident. A fellow merged into me, perty clean cut his fault. Cops arived said it was a waste of thier time and it was clean cut the other guys fault. My insurance notifyed me i was not at fault. The other guys insurance notifyed me i was not at fault. Now fast forward to today, i get a thing in the mail from this guys insurance stating i perty much owe $3K for damages. Now to say the least i want to seriously hurt someone at this point. Anywho i notifyed my insurance and they said my agent should call me tomarow and hopefully get this resolved. Now when i called my insurance they had a record of the incedent but it was closed and i was not at fault, they had not recieved notifcation of any pending damages against my policy. Now should i talk to a layer? Im seriously kinda worried as im just 21 and i dont have that kind of money. Im also wondering if i should get base legal involved (one its free for me since im in the AF) and two since it appears my insurance company was not notified it seems im trying to be intimidated into recooping the costs of the other guys insurance. So anyway, im just kinda looking for advice on this. Should i just talk to my insurance agent tomarow and play it by ear? Also one thing that did not impress me about the police is there was no report filed, and me being dumb and young didnt take down the officers name or badge/unit number in case this happened. Also i unfortunately dont have any of the mail from the other insurance company anymore stating the claim was in my favor. I thought this was done before it statrted and my insurance company handled it. So anyway, thanks for any help you guys can throw my way. |

MIght be complete BS. I'd let your Insurance handle it. If you do not allready deal with them, sign up for USAA. They freaking ROCK and really will take care of you when you need it. They are the best, not the cheapest but the best. I had a friend in a similar situation and YES USAA was his representation throughout. Bonus is that it doesn't or SHOULDN'T cost you a thing. Be warry, but I wouldn't freak out yet. ETA: Under NO circumstances should you talk to ANYONE from ANY other Agency other than your own Insurance about this. No phone calls no responses in letters. NOTHING, not a single word. If things somehow DO end up in court, it's real easy for them to use ANY statement you make against you... |
+ 1 Definitely don't talk to them. Find out through your agent who will handle this and get a copy of this letter to them ASAP. and sit back and let them handle it. If you continue to get correspondence pass that on also. |
| This one can't help you now but in the future when the police do not want to be involved. TELL them you are injured. They get no choise to go for donuts then they have to investigate. Just say your back, neck whatever hurts and it did not before. I went through a very similar thing years ago and a insurance agent told me that was the way to solve that problem. (by the way it took about 2 years to get it straitened out in my case) |

Relax. Take a deep breath. Just cause you received a letter doesn't mean that you gotta run right out to the mailbox with a check for them. I had a similar experience about 10 years ago. Make copies of whatever documentation you have from the insurance companies that had previously notified you that you were not liable. Send said copies, along with a copy of the demand letter, to your agent with a cover letter requesting that he make it go away. Keep a copy of all such correspondence for your file. I did, and never heard another word. You may also wanna check into a membership in Pre-Paid Legal. If the issue reaches the point where you need to stomp on either of the insurance companies, PPL is a pretty inexpensive way of getting an attorney on your side, regardless of where you live now or where you might move in the future |

Well i chatted with my insurance agent today. She was confused about why they came after me and didnt notify them. It seems they think i was uninsured or something other silly error. Anyway my agent said to just kick back and shell take care of it and contact me if she needs any more info. Thanks for the advice guys, i just kinda got spooked by this since im still perty young and if i had to pay that would mean no .50cal |
One other thing, just in case, you may want to check is the statute of limitations for them even being able to take you to court about it. I know that in a lot of states you must be subpoenaed in less than one year of said accident for it to even go that far, happened to me in Cali a few years back, but I was served papers with only two weeks to go. They couldn't get any money out of my insurance company so they decided to go after me, money still comes from the same place but they don't care as long as they get it.-z |
Good deal...Just to make sure, I'd contact base legal and have a quick chat to ensure that you are covered...some things that stand out in the above responses are that there are folks who make millions screwing young GI's and airmen, the other parties insurance is looking to bully you, and that you should definetly let your agent handle this. Also- It'd be a good idea to let your 1st line leader/supervisor know what's happening, you never know what letters the Sq/Wing/Flt commander might get. ![]() Matt |
