I had a close (enough) call with the Breed of PeaceTM last night while out for a walk with the family and dogs. My question is not about the use of deadly force on a dog in public, because I was *going* to kill that thing the very second the green light went on. My question is - What specific AZ laws are violated by a person when they fail to control an animal resulting in it 'running at large' and 'menacing', and are there separate violations if the dog causes damage to another person or their property (i.e. their dogs)? Are these enforced by cops or animal control? Are they civil infractions or criminal violations? I understand that police police people, and animal control polices animals. But where is the line? Most places have dog at large city codes.
In Phoenix, you are required to have a license and a collar for a dog 3 months old and up. If your dog is at large, and wearing a collar and license, the violation is civil. If the dog is at large, and is not wearing a collar and license, the violation is criminal . Maricopa animal control enforces those, and will respond to cite owners. They usually take the animal too, if it is unlicensed and unvaccinated. Phoenix PD will not take reports on dog bites. You are entitled to restitution and or civil claims against the at large dog's owner, if his negligence caused you damage. |

This particular dog slaughtered one of its peers in the neighbors livingroom a couple months before my incident, it also apparently hated babies... no license, no vaccinations... So all you need to know is the address of the place the dog lives and they will go and knock on that door and tell them to keep the dog on a leash. A couple of douche bags required several visits from the Sheriff, but it got the job done. |
| I'm in Scottsdale and my roommate was walking her Golden Retriever and a guy who had a pit had it loose in the yard and it ran out and attacked her dog. Did over $500 in damage that he paid cash right away. When the Dawg Pound came to take the report I asked what I should do when I'm walking my Lab and he said I could shot all the way until it makes contact with my dog. That if I get hurt seperating them it's on me. I can use the defense that until it makes contact with my dog that I thought I was the intended target. He said each city has different protocols for this and Scottsdales was one of the worst for the defensive owner. Don't get me wrong, I love pits. I grew up with one and she's as sweet as can be. It's the owner and the wrong type, if any discipline that makes them that way. It would tear me apart to have to shoot a dog but would tear me apart just a little bit more if my dog was hurt by it. |

Although the unleashed attacking dog would have had a rude surprise with the dog I was walking |

Thanks for the responses. During the incident I eluded to in my op, the Dog of Peace was being walked by a yoga pant chicky snack with a half sleeve (...so much for economic segregation). She was walking toward us on the same side of the road. When she saw us she crossed the street...she knew what her dog was going to do. When she was across the street and even with us her dog lost it's marbles. The leash she was using was completely insufficient for a dog of that size, strength, and drive. It was my intention to shoot it dead when it got away from her as soon as the shot angle allowed for bullets to hit the ground at an angle which would take most of the steam out of them....not my first rodeo. I've had a bit of practice at this. This would have been number 5 if it went shitty. Fortunately we were able to un-ass before that happened. I *really* don't want to be that guy in the neighborhood. Again. Trust me when I say it's no fun. |

They aren't allowed to stray more than a foot away from me. Seems most dog owners are woefully ignorant of controlling their animals.

I wanna rub his belly. My buddy across the street has a 5 y/o Rott about that size. Dog has thyroid issues and can be a bit 'temperamental.' My buddy knows what he has is really responsible with the dog. I was over at his place sitting on the couch and that dipshit snapped at my face without so much as hint that it was coming. I had been warned, but I'm a pretty keen read on mutts. Not an all out assault but he was certainly vying to establish his place in the order of things. I laid that ol' boy down like right now...I swear to God I could hear that dog thinking "Holy Shit!!" Or maybe it was my buddy's spontaneous utterance I heard...I dunno. Bax has been my best bud ever since. Always approaches me submissively and seeks affection and approval. I won't let my kid near him though. |

I got attacked recently and thought of some of 7M3's stories lol. I could have easily and legally smoked the dog that attacked me but I'm too much of a dog lover and I couldn't bring myself to do it. I was in a customers yard working when all of a sudden Satans Hound jumps the neighbors fence and starts running right at me. I had a 3 foot long lead pipe in my hand connected to my chemical hose that was spraying some nasty hybrid bug/weed killer at the time. I had a lot of options I could have sprayed the dog in the mouth/eyes with poison, shot it, or hit it with the pipe. I couldn't do it though I love dogs too much. I kicked it once that threw it back a foot and I cranked on my chemical fan and sprayed its feet to keep it back. I slammed the gate on my way out and locked it in. It must have had leverage to jump the fence from the neighbors yard because it couldn't get over the gate I closed. I called the customer and let him know I couldn't finish his service because there was a wild animal trapped in his backyard and he said he was calling the cops. |

Constantly playing the one-upsmanship game to see if he's above you or beneath you. God help any dog that gets within his reach. Needless to say, I don't let him interact with anybody or anything other than me. He's closing in on 8 and only has a couple more years most likely. |
