They only have four more days until 120 and they have been here twice in the last 10 days.  Last night the guy looked angry while he was knocking on my door.  He parked his car in the middle of the street away from the line of sight from the peep hole.  I peered through the blinds and when he got into his car he backed up down the entire street to leave.  I guess he didn't want the possibility of me seeing his plate.  Ironic 'cuz only a couple of hours before I looked at my wife's ticket to see how long it had been since the notice of violation.

Some people on here say man up and pay, but this is just a revenue builder.  I think red light cams serve a purpose because they do cut down on red light runners once people are familiar at what intersections they are located at.  speed cams do not.  

I'm LEO... ignore the notices.  Once the cost to benefit ratio flips these camera's will go away.

I'm surprised they are really trying to get the documents to a person.

A while ago, I was living with a roommate (who had a photo radar flash him), and the server came to the house just as I was leaving the driveway in my car. He started yelling at me, but I ignored it and backed out and left.

When I came home to papers were taped to the door

Most of the time these jerks will just leave the docs on your doorstep and claim service.

A process server is supposed to deliver it to the person, or another responsible person that lives with the individual.  He can't leave it taped to the door and claim service.  I would have fought that.

You're right about the cost / benefit ratio. I just wish more people would do what you're doing and make it more expensive to serve you than what they'd make if you paid the ticket.

They just have to articulate that they believed someone was home when they left it on the door.  IMO, pulling away in the car while ignoring the guy might cut it...

This is what I was wondering.  I know a judge can say it's ok to post on the door if previous attempts have been made.  I'm not sure if this applies to photo radar?

I believe the law is that you must be served.... there was a guy leaving the papers at the door  (either on the doorstep or porch) and his licsense got revoked and he was arrested.  something around 500 cases were dismissed because of him.  ....   let me see if i can find the article.....

That is a BIG negative.
These court papers have to be served to a human, who acknowledges the defendant named lives there, or to the defendant.
I went, I saw, I served: That's it.

If he sees someone peeking though the blind next time, and you refuse to answer the door, he can leave it, and articulate that.
But they are not legally allowed to leave the paper just because they think someone is home.

FWIW,
There are very few instances where court paper can be left without anyone being there.
One is a certain type of Writ, and the other, any hearing related paperwork reference evictions from real property.

The only Writ you can leave without serving is reference automobiles, boats, MC's etc.
It's like repossession, but with a superior court order.
With that Writ, I can take the vehicle, and leave a copy of the paperwork where the vehicle was under the biggest rock you can find.
Home, work, shopping mall, where ever.

I kid you not, With that Writ, I could peek in you garage, see the vehicle in question, and even if no one is home, do what ever it takes to get the big door open, and take the vehicle.
I've never had to go that far, but I can, and by that time, it's already well established in court that you are hiding the vehicle out.

That's what I was thinking about.  I was thinking he could articulate that someone was home because he saw an adult and talked to him, even though he refused to answer.

But, I see where you're coming from.  It would be impossible for him to articulate that that adult even lived there.

You should have talked to the man.

"Are you Joe Smith"?

"No, I'm Bob Jones, and here's my state issued identification that proves that."

No service, since you aren't the guy named on the paperwork. Since you drove off, the process server has a valid suspicion to believe that you were the person on the paperwork, and were avoiding service.

THE ONLY WAY TO WIN IS TO FIGHT THE PROCESS OR PASS A LAW BANNING CAMERA'S , WHICH NEEDS TO BE DONE. I DIDN;T ANSWER MY DOOR 4 OVER A YEAR THE GUY WAS TRYING TO SUE EVERYONE THAT WORKED AT THE MORTGAGE COMPANY , WHICH ISN'T A SURPRISE. WHEN THE HOUSING MARKET WENT SOUTH HE JUST STOPPED SENDING OUT PROCESS SERVICERS. ?

Why are you speeding anyway?  As a fellow LEO, I find it abhorrent.  I don't speed unless emergency driving is neccessitated by work, and even then, I feel really dirty.

WHEN THE PHOTO RADAR REPLACES COPS,how you going to feel then .as far as speeding makeing you feel dirty just don't speed and take a shower . you should have thought of that B4 going on the job.

I got mine on the I-17 at Bethany Home Rd. Was in the center lane, maintaining a safe distance between myself and the vehicle in front, running with the flow of traffic at approximately 65 mph. The driver behind me was following too closely for comfort. The vehicle alongside of me and slightly ahead, gave me subtle clues that they were going to change into my lane. I rode a street bike in PHX daily for 10 years so I have experience with blind spots and subtle clues.
I accelerated to 68mph to move out of their blind spot.

than cordial. Suffice to say they will earn their fee. I did not choose their employment for them.
Will they even attempt to serve me in Prescott? I don't know, but for the remaining 60 days my liberties are compromised.

Oh and by the way, Tommy Rajak is still a flaming asshole.

Chuck, how do you really feel?  Just so you know, I found out from DPS that they will send out the notice of violation if the photo is grainy, and ask you to identify the person driving.  However, if there is no option to pay on your initial notice, they left that out intentionally because of poor photo quality.  If you got an initial notice with no fine,they won't even send a process server.

Just so you know, yo MUST be served legally.  BUT - if you respond in ANY way to the fishing expeditions they send you that is waived.  So if you want to claim you don't know who was driving and send it back they got ya.

Toss them into the garbage where they belong.

I responded to one, and listed that I was the driver.  When I didn't get a response after three months, I called them.  They told me they dismissed it due to poor photo quality, and thought I had three heads for inquiring.  Not saying my way was advisable.  Being LEO, I simply wanted to make sure they didn't suspend my license unbeknownst to me.

I am going on 90 days from my "violation".  Someone I did not know came about a week ago, I just ignored him.  One more month to go.
