Me and my girl are talking about moving to AZ.  

Her motivation - have a big house for cheaper than in San Diego

My Motivation - It is a "free" gun state and I have can carry and possess 30-Round Mags and shoot on my property all day long and never worry about it.


So, we found a common ground and are thinking about moving to Anthem (Outside Phoenix).

My question is this.  (Now, remember, we can't even talk about Full-Auto in California, so my education is limited on the topic)

If I wanted to own a Fully-Automatic AR-15 or AK47 in the State of Arizona, what exactly would I have to do?

Is it as easy as building an AR-15 with M-16 parts, or dropping in a DIAS?  What would have to happen for me to legally possess a Full-Auto weapon?

I have heard that you have to buy a "tax stamp" and purchase a NFA (what does NFA stand for)??   Would I really have to spend $10,000+ just have a full-auto weapon?

Please advise.

I would LOVE to turn my selector switch all the way to the right....

If your planning on living in Maricopa County I wouldn't plan on shooting on your property if I were you. Other than that your spot on. Open carry? Just get a permit and conceal.

Calss 3 stuff needs to be purchased legally. You can't just build one. You'll spend anywhere from 10-20K for legit full auto stuff.

One cool thing though, within 24 hours of moving here I had my drivers license and a brand new AR!

Suggest you try www.usautoweapons.com which is a website for a Scottsdale Class III weapons retailer.  The info on the site should get you started on getting answers to your questions. You can call them, or post questions via e-mail.  There will also be a listing of their current inventory.  There are several Class III dealers in town, this just happens to be the only one I know the web address for. The County Sheriff is very supportive, I understand, on getting the required paperwork through his system and then on to the BATF.

P.S.  There is another seperate retailer about a hundred feet away where you can rent full auto weapons on-site for a try-out. (Scottsdale Gun Club)

Since 1986 you can no longer Form 1 a machine gun.  You can only purchase something that was on the NFA (National Firearms Act) registry prior to 1986.  

Prices for automatic firearms has gone up dramatically in the last few years.  I think the cheapest you can find anymore is a Mac in the $3000 to $4000 range.  I haven't priced an RDIAS in a while but I think they are going for $8000 and up.  In order to purchase one, you would need to find one in-state that could be transferred direct to you (or your trust) on a Form 4 or find one out of state that could be transferred to a Class II/III dealer in your state and then on a Form 4 to you.  Each Form 4 transfer costs a $200 tax.  If it starts on a Form 4 it will be $400.  Sometimes the seller will cover the first transfer.

don't forget the supply if anything goes down each year, thus driving the prices higher.

i'm glad i got mine when i did.. prices have gone up over 2k on the M16A1's since I bought mine. M11's have gone up around 500-1k since I got mine.

 Here is my attempt to list what state allows what in terms of
NFA weapons.  The "Y" indicates state law allows private
individuals to own the weapon in question.  Most of the "Y" states
require the weapons be possessed in compliance with federal law to
be legal under state law.  Some of the "N" states may allow only
police officers to possess them, or dealers, or neither. Basically
if the privileged class was so narrow, by statute, I said "N".   In
many states the class of folks able to own NFA weapons is narrow by
practice (California), or because no law enforcement officers will
sign the certification needed for a transfer to an individual.
Some of the "N" states may also have grandfathered weapons, the "N"
applies to a  current transaction.  Some "N" states may also allow
unserviceable weapons.  Some states may regulate one or more of
these weapons as handguns.

         A Note about NFA Weapons and California

As a general rule the definitions of NFA weapons, as regulated in
California, track exactly the federal definitions, and categories.

Cal. Penal Code Sec. 12020(a) prohibits the possession of, among
other things, AOW's (Any other Weapons) and short shotguns and
short rifles. Subsection (b) lists exemptions to the application of
(a).

Subsection (b)(7) of section 12020 exempts any "firearm or
ammunition" lawfully possessed under federal law and on the C&R
list. Subsection (b)(8), exempts ALL AOW's except "pen guns."
Subsection b(2) is the exemption for the movie permit for short
shotguns and short rifles with the procedure for its issuance found
at section 12095.

In short, Californians can legally possess any AOW, except a pen
gun, as long as it is possessed in compliance with federal law, and
as long as it isn't classified as an assault weapon (SB 23 treats
some semiauto pistols with dual pistol grips, AOWs under federal
law, as prohibited assault weapons).  Likewise they can possess any
C&R listed short rifle or short shotgun.

Short shotguns and short rifles are defined at (c)(1) and (c)(2)
respectively; the definitions are essentially the same as federal
law.  HOWEVER, unlike the feds, California courts have ruled that
the length of a rifle with a folding stock is measured with the
stock folded, not extended, as the feds do.  So a gun that is not
a short rifle under federal law may be one under California law.
See People v. Rooney, 17 Cal.App.4th 1207 (1 Dist. 1993).

Any firearm whose possession is otherwise prohibited by subsection
(a) is ok, under b(7), if the gun is a C&R one and lawfully
possessed under federal law.  This would not provide an exemption
to the requirement for a state permit for a machine gun, as
12020(a) does not regulate mg's.  That is section 12220 (ban) and
12230 et seq. (permits).  Rules for DD's are at section 12301 et
seq. Silencers are regulated at section 12500 et seq.  The state
Department of Justice has discretionary authority to issue permits
to possess DD's or machine guns, and does not issue them to
collector-civilians.  Civilians are totally prohibited from owning
silencers.

Two places I would not move to are Anthem, and Johnson Ranch(south of Queen Creek).  Mainly due to traffic congestion.

As for class 3, buy it if you can.  I would suggest a M16 as you can run multiple calibers off of it.

Don't forget Suppressors!

What's nice is I will be able to sell my home in San Diego (which I built with my own two hands) and have enough money to buy four similar homes in Arizona, so I'm not going to get too caught up on the price of rifles.

If you buy in or around western Buckeye or Tonopah there is almost unlimited flat land to shoot on,  I've been shooing at Iron Mountain for the last year.  Ben Avery is okay 15 min. shooting session and 20-30 min cease fire, there are more idiots at ranges than there are in the desert, and I don't think the people there like chain guns except the RSO's can't leave me alone when I take mine, the old WWII stories of the men who carried them.

Not exactly.....There are some folks here that are Class II manufactures, who can build machine guns.  However, they can only sell them to Govt and LE.  They can shoot them all they want, but when they give up their Class II or SOT, they must destroy the receivers.  These types of weapons are referred to as "Post Samples".

Generally speaking....you are looking for a "transferable machine gun" made prior to the May 1986 law.

The price may seem high now, but in twenty years we will be on ARF.com telling tales of how we got an original Colt M16 for less than $50,000!
