A quick update on HB2325. The bill was heard in the AZ Senate Judiciary committee on 3/21. To make a long story short, it was amended by Sen. John Huppenthal in committee to do away with the lifetime provisions, changing it to be a five-year renewal term instead. This will preserve the NICS waiver status of the AZ permit, so we won’t lose the Brady check exemption when buying a gun. I know this was important to some folks, and not to others, so take it for whatever its worth to you.

Huppenthal’s amendment also restored the four-hour refresher training course requirement upon renewal. He also tried to restore the lengthy training requirement for the original course, changing it to fourteen hours from the original sixteen. Basically, his amendment gutted the bill altogether, pretty much putting the language of the statute back to where it was originally. But Sen. Jack Harper had an amendment to his amendment waiting, cutting the original course requirement back to eight hours, as Rep. Gray’s bill intended. After debate, Harper’s amendment was adopted, and eight hours it is. The bill now moves to Rules, and then to the floor. There is a chance that there will be further amendments there, during the Committee of the Whole debate, so stay tuned, and be sure to keep in contact with your Senators.

For those interested, HB2325, which is now a bill to extend the CCW permit term to five years and shorten the initial training course requirement to eight hours, passed out of the AZ Senate Rules committee yesterday. The next stop is the Committee of the Whole, where it will be subject to further amendments. It has not been put on the COW calendar as of yet, but it won’t be long now. Please contact your Senators and politely ask them to support the bill without any damaging amendments.

Spoke with the sponsor's office yesterday, the bill was retained so they could work on an amendment ("retained" means held on the calendar until further notice). It will be back shortly as soon as they have the language together. Will keep you all posted.

HB2325 passed the Senate Third Read yesterday by a vote of 28-1-1. You can find the vote detail here …

It now goes back to the House for a concurrence vote or a conference committee, as the bill was amended in the Senate. Some of those amendments, which were adopted during the floor debate, shortened the renewal course to two hours, changed the renewal fingerprint requirements to the first renewal only, allow a defense to prosecution for not carrying a permit if the person can present a valid permit to the court, and allow for service members serving overseas to extend their renewal dates until 90 days after their return home. What is the impetus for wanting to change the law at this time? what effect will it have on reciprocity with other states that we enjoy now? I think there may be more negatives to this than meets the eye!

It will have no effect on reciprocity whatsoever that we are aware of. Why would it? The vast majority of shall-issue states have far lower requirements for permit issuance than AZ. The only exceptions to that would be TX and NM. My suggestion to both of those states would be to get busy in their legislatures as well.

Freedom has a price. One must be willing to work for it.

Thanks for the response. I hadn't read anything on the reciprocity aspect. I travel in some adjacent states occasionally and was wondering if changing our requirements would effect it. Glad to here it.

AZ House Members

The bill now makes the following changes to the CCW laws …

- Permit term raised to 5 years
- Military types serving overseas get a 90-day extension on the renewal term
- If you are charged for not having your permit on you, the charges will be dropped if you can show your valid permit in court.
- Initial training requirement dropped to 8 hours.
- Renewal training requirement dropped to 2 hours.
- Fingerprints are only required for the initial permit and first renewal.

After this, it moves on to the Governor for her signature or veto. We need to start contacting her and letting her know that we want a signature on this one. Contact info is as follows …

HB2325 passed the House Final Read by a vote of 40-20, and was sent to the Governor on Wednesday, April 20. We need to get on her case to sign this bill, which passed the legislature with a veto proof majority. Well no, not exactly. The Governor still has to either sign it or let it pass without a signature. She can still veto it if she so desires, but doing so with the vote margins it garnered is very risky for her. Especially if she vetoes the Restaurant Carry bill. With the Budget veto looming over her, and the likelihood of a special session in her future, does she really want to risk the possibility of an override vote on this bill, and the embarrasment that goes with that? Its a slim possibility, to be sure, but still a possibiliy, and one I'm sure she'd rather avoid. Given the broad support for this bill, she'd be a fool not to at least let it pass unsigned. And Janet is no fool.

Assuming that she signs it or lets it pass, it will take effect 90 days after that event. I believe she has until next Wednesday (4/27) to make up her mind. That would mean that it should take effect sometime around the beginning of August. Given that DPS will have to come up with new course guidelines, regs, etc., you may even see some delays beyond that, but hopefully not much.

Since laws are not generally retroactive unless they specifically say so (and even then its touchy, and frequently challengable in court), your permit will expire when it says so, and on renewal, will be valid for five years. Your renewal class will only be two hours long though.

All of this is, of course, assuming that the bill is signed by the Governor. Calling, faxing, or writing her will help that along ... (hint ... hint)
