I know I know not another census thread but im so pissed right now its hard to see straight.
Last week a cw came to my door and all i gave him was 5 the same thing i gave to the last one that came to my door
the same thing i put on the form  and mailed in. Well he then told me that i was one of those teabaggers and started to spew his bull shit
so i went back in the house . Today that fucktard showed up at the house again, walks right up to me and says O its you the teabagger  are you
going to answer my questions today , I looked at him and said 5 that's all you are entitled to .  ( the wife was watching in the kitchen window)  the
fucktard starts to tell me that im a felon and better answer his questions or he is going to turn me in .I told him all i have to answer is how many were
in my home and that was 5 .He said that Congress has written a special law that requires me to answer all his questions so i said according to the US
Constitution all im required to give you is the number of people in my home to be counted . fuck it this can go on and on  the whole thing blew up in to a shouting
match and my wife had to come out to separate us because the guy was starting to verbally attack me and I don't talk shit I just do .   so he's is telling on me
for not giving him what he wants.

The census worker came back today and was asking my neighbors for my information.  My question is, can they legally do that?

You're wrong. To "enumerate" is to list as well as count. Stop thinking politically for the moment; they need to list the names to be sure you're not counted twice. (or to at least attempt that) If you list your occupation and relationship to the others, it helps establish that you are not the same John Smith as the John Smith two blocks over. This is not new; they have been doing this from the beginning. From the 1860 census form I know that my great grandfather was a "farm hand".

They DO NOT need to know what your house is worth, how many toilets and TVs you have, but they do need to accurately count the population.

and you continue to answer the door?

Either tell him you accept the 100 dollar fine for refusing to answer the questions telling him in no uncertain terms to leave.   I have seen nothing that suggests they can charge you with a felony, it's a 100 dollar fine for refusal and a 500 dollar fine for deliberate incorrect information.   If none of those suit you, tell him you'll answer the questions to a supervisor after they have come out to take a formal complaint.

Taking crap from some argumentative smug census worker is not something anyone should have to take.   The nature of their shitty job is to take crap, not give it.   If they receive crap it's their position to inform of failure to comply and then leave if a person still refuses to talk to them.   Getting into a political debate and causing a peace disturbance?   Call the cops and make it truly official if you are brave enough to take it there.

I have filed a police report today because the guy said that when they come back they will get rough with me.

Next time a census worker comes to your door have a video camera taping the entire interaction.  We should see everything from the moment the door opens until they leave.  Have a third party do the taping.

The ONLY QUESTION you are LEGALLY required to answer is the very first one; which is How Many People reside at that residence.

There is no $100.00 as long as you answer that single question (which is all I did).

If you looked at the census form, you might have noticed that the first question was placed within a seperate box.  That is because it is the ONLY QUESTION you are LEGALLY REQUIRED to answer.

Folks will probably chime in that you need to answer all of those questions... that are wrong.

"Acting as an agent for the owner of this property, I hereby inform you you are trespassing under California penal code section 602.o. Your failure to leave and/or subsequent return to this property will result in your immediate arrest."

This statement is completely wrong because of a section in 602 that protects people "engaging in activities protected by the California or United States Constitution". But hey, he probably doesn't know it.

The minute he steps on your property like another poster stated video tape and not only that also take a digital picture.  It would also help if any of your neighbors are at home and avaible to come out see the event of "him roughing you up".  Not only you can peg him for harrasment but also assault and battery.  By the way don't forget to get his name so you can call the census office to make sure he is legit.

From the United States Constitution:

Article I, Section 2, Clause 3

Clause 3:

The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct. The Number of Representatives shall not exceed one for every thirty Thousand, but each State shall have at Least one Representative; and until such enumeration shall be made, the State of New Hampshire shall be entitled to chuse three, Massachusetts eight, Rhode-Island and Providence Plantations one, Connecticut five, New-York six, New Jersey four, Pennsylvania eight, Delaware one, Maryland six, Virginia ten, North Carolina five, South Carolina five, and Georgia three.

"in such Manner as they shall by Law direct"
It's not rocket science; you don't even need a lawyer to figure it out.
