AB 2728, as amended, Klehs. Firearms.
Existing law establishes a list of certain firearms by make and
model as assault weapons and otherwise describes or defines certain
firearms as firearms.
This bill would provide that the term “assault weapon” for those
purposes includes the frame or receiver of the weapon.
Existing law provides a judicial procedure for declaring a firearm
an assault weapon, as specified.
This bill would repeal those provisions.
Existing law authorizes the Attorney General to declare a firearm
an assault weapon.
This bill would provide that authorization ends January 1, 2007.
Existing law generally regulates the possession of assault weapons
and .50 BMG rifles.
This bill would provide that possession of any assault weapon or of
any .50 BMG rifle in violation of specified provisions of law would be
a public nuisance. The bill would authorize the Attorney General, any
district attorney, or any city attorney to bring an action in superior
court to enjoin the possession of the assault weapon or .50 BMG rifle.
The bill would further provide that any assault weapon or .50 BMG
rifle possessed in violation of specified provisions of law would,
subject to exception, be destroyed, as specified. The bill would also
provide that upon conviction of any misdemeanor or felony involving
an assault weapon, the assault weapon would be deemed a nuisance
and disposed of as specified.

It means "identify as an AW by Jan 1, 2007 or it'll never be listed an AW"

If you read the whole bill, you'll see that it's more complex.  It would allow lockyer to "list" anything, AR/AK or not without judicial add-on procedure, but only until January 1st, 2007.  They'll probably edit that out.

There's no way they'll bother adding M-14 rifles to the list even though they can... Reg those and it's SAGE time.  It's more likely they intend to go after FAL and G3 clones.  According to the language of the bill though anything is fair game including your remington M700 scoped black evil rifle :(!

After reading the law, my head is spinning.  Just tell me if I should be for or against this.  That way I can call, write, email, scream, donate first born, whatever to help or stop this bill.

I don't see where there will be any provisions for listing any additional firearms as assault weapons after 01-01-07, this could be good.  What I mean is if someone comes out with something really trick, they won't have provisions to put it on the AW list.  

I really don't see this bill gives the DOJ any additional authority to list any other weapons other than AR/AK type.

If the DOJ is required to list by 01-01-07, this could be good again.  We may actually get to register our lowers.  I am however guessing they will simply photograph a generic AR-15 lower receiver, so the make and model thing would no longer matter, this would be bad.  No more importing lowers, only completed, neutered rifles.  Any conversions from offlist lower to completed neutered rifles would only be allowed by those authorized to work on assault weapons (price goes up), bad again.

I am now certain the memo was to get our minds spinning, and was complete bs.   A tactic to slow the sales down pending this legislation.

Let's not panic over this...

1) it's preliminary and hasn't gone thru multiple edit/amend cycles yet
2) there are only 2 more Public safety committee meetings (2 in next 2 wks)
3) it would still have to pass a floor vote
4) it would have to be signed by Gov (unlikely, as AWs are a 'solved' issue and gov has stated gun laws are too complex anyway and need simplification (even Gray Davis said so!)
5) not enough votes to override a veto

There are a variety of structural weaknessess in this, so far.  Let's not tip our hand and discuss them publicly, esp at this critical time when things are formulating.  Let's not do their work for 'em :)
