| I'm a newb resident and haven't tried to purchase a gun yet. I have a question. My drivers license is still NJ because I can't change it until I sell my house or NJ, most fucked up state ever, will charge me an exit tax equivalent to 8.97% of the value of my home. It's so fucked up here I can't even tell you. However I want to buy a few awesome guns that I couldn't own there. Can I get some form of state ID or use my NJ DL? I'm a legit homeowner. |
| I could be wrong on this so take it with a grain of salt. If you can show proof of residence, (lease, power bill, etc) then you might be able to purchase. When I moved to Orange county from Dade, Wally World wouldn't sell me a shotgun until I brought them those items. This was in early 2001 though and I still had a FL ID. Somebody will be along shortly who knows more than me. |

I managed a large retail firearms store in Las Vegas before moving here. When we would make the call for a background check, the state wouldn't even let us process the check on a state issued ID if there was also a DL issued in another state. Whether the customer volunteered that info or not, it would always come up when the tech attempted to run the check. Customers were required to establish their residency before attempting to purchase firearms as a resident. Part of that process is getting a new DL within the requisite time period as spelled out in the laws of that state, often 30 days or so. One of the only exceptions to this issue were active duty military could purchase in their state of residence with their DL or the state where they are stationed with their military ID, a copy of their PCS orders showing them stationed within the state, and a supporting document such as a utility bill issued by a state or local government agency showing residency within the state. Federal law protects their ability to do so. The other exception I know of was active LEOs purchasing on department letterhead could purchase duty firearms in any state regardless of their actual residence, but this only applied to firearms spelled out specifically on the department letterhead.
To be honest with you, I don't know that I would bother with trying to get a state ID. You're going to pay money, waste time, and potentially not be able to accomplish what you intend. You may be able to purchase long guns using your NJ DL as your residence as long as you still own the residence at the address on your DL, but you won't be able to purchase handguns or receivers unless the federal laws have changed recently. I would work hard on getting your home sold as fast as possible and establishing residency here while you save up some fun money and be ready to purchase as soon as you have your new DL. |

I don't have any of those qualifying items so I guess I can change my address at my leisure. I'm talking to my accountant how to avoid the exit tax and change my address. It's a weird rule and NJ just can't tax enough so one more tax on the way out the door. |

I spoke to an FFL nearby. I can buy a long gun on my NJ license from him but I have to have a Florida ID (D/L or other) to buy a handgun. Also, if I apply for a Florida state ID (non-D/L) it will invalidate my current license I've just found out. Thank god I can at least get a good long gun while I'm waiting. ARs in NJ are neutered really badly.
Now I just need to find out where I can get a safe locally. Thanks for the help everyone. |

Yes getting a 'Real ID' in one state, the other state will revoke your ID there. You do not need a Florida ID/DL to purchase a handgun (any gun) in Florida. All you need is a government issued document that shows your Florida address: Tax bill, car registration, etc. The ID proves...well, ID....the other document proves residence. Folks that live in more than one state do this all the time. However, it might take a little work to find a FFL that understands the law and is willing to perform the transfer. |

I know the law changed some time back reference having a FL DL and a FL ID, I used to have both, was not thinking about the out of state aspect of the ID card. I used to have my PO Box on my DL but the gun shop said I had to have a physical address... so I got a FL DL with my address just for that reason. Then when the law changed, I had to give up my FL ID and have my address changed on my DL. |

Then when the law changed, I had to give up my FL ID and have my address changed on my DL. Yep, I had both also. Kept the ID together with my FLCWFL but separate from my DL. When I tried to renew my ID online, I got a big red flag that my DL would be cancelled. At that time my DL was not a "real ID" and so I did a little research. Florida decided to err on the safe side and simply not issue both, real or not. |
| As far as guns are concerned you can be a resident of more than one state if you have more than one residence. You are considered a resident of whichever state you are physically in at the time (provided you have an actual residence in that state). You just need to be able to show proof of residence (utility bills, etc) and identification (NJ DL should work). It's actually spelled out on the 4473 in the various notes no one reads. |

It seems like I should be able to buy anything while I'm in FL.
The explanation of question 13 on page 5 actually states how to select your state of residence. The example given is if you are buying a firearm while at your weekend home in State X then list your address in State X in response to question 2. I read that as if I am at an FFL in Florida with my NJ drivers license it is perfectly legal (seems like required) that I list my Fernadina Beach address for question 2 on form 4473.
