A relative of my wife wants to give me some handguns. As a non resident can I legally transport them to the FFL for transfer to my local shop? The relative is not a resident of Florida either but the parents were and the handguns were the fathers'. What paperwork if any do I need from the relative? I appreciate any help. Thanks

For what its going to cost ya for the transfers I would think you could get a cheap flight down .  Then just pack them in an approved box and take them home with ya. Shipping cost plus the transfer fees on both ends is going to add up.  You would get a day in the sun shine to boot

ETA I would get a bill of sale too it can't hurt to have one .

Federal Law requires that the guns be transferred interstate through an FFL.





The relatives can ship the firearms directly to the receiving FFL as long as the receiving FFL will accept them from a private party (no legal reason why they can not do so, but some FFL's have their own requirements)

Any place else but NY, it could be easier....  understanding that you need each handgun approved onto your pistol permit by local law enforcement makes no easy way to get them in state.   I think you are going to have each shipped to an FFL and pay the transfer fee... that is if you have it all worked out on your end.   Most other states you can just do the deal, NY is much more restrictive.

I understand handgun ownership requires a permit in the state of New York.  I also understand a handgun permit is not easy to obtain in New York either.  Concealed carry is pretty much off the table unless you're some kind of specialized security or you're active duty LEO.  I remember my cousins years ago coming down and looked in amazement of some of the stuff I had procured in my collection.  They couldn't believe I could own some of the things I had.  Most of it, they had never even seen.  My one cousin was blown away that I could simply go to the store and buy him a stun gun and send it to him (came in handy for him one night whilst club hopping in the City with his friends).  And they still have yet to grasp the concept of not neediing a "permit" to own any of it.  They still don't quite understand I simply go to the store, pay for what I want, and walk out with it.

Thanks all. I have a NY permit so that is not an issue. I didn't know if I could have them in my possesion in the state of Florida while bringing them to the FFL. Last thing I need is to be pulled over by a Florida Trooper and have a couple handguns in the car and me not know the rules. Looks like I can bring them to the dealer with no problems. The relative cant do it themselves.

Yup, as long as you would be permitted to purchase a weapon (no felon, domestic history......) you may carry a weapon in your vehicle.  No three step or any of that crap.  This aint NY.

So if you come down to pick these up whats stopping you from just getting a lock box and CKing them in with your baggage at the airport?  Your not shipping the guns interstate.  I have picked guns up out of state before and retuned back here with them.  No one at the airport said BO about it and they knew I didn't fly out with them.

So what about NY then can a out of stater travel though NY state with a  handgun And not have the permit??

Every hand gun you own is listed by make, model, caliber, and serial number on the back of your NY Pistol Permit. In order for the permit to be amended, he must transfer the guns through an FFL in NY.It would be a very bad idea to possess handguns in NY that do not on your permit.

As for your last question, yes you are be able to lawfully transport a handgun through NYS according to the Gun Owners Protection Act. However, NYS likes to ignore Federal law on that particular issue. Unless you have the time and money to fight it in court, don't try to bring a hand gun into NYS. Period.

No three step rule there either.

Of course, you must also have a valid NYS pistol permit to even possess.

In NYC it is virtually impossible to be granted a pistol permit. Nearby counties vary. It is a very easy and often quick process in upstate counties.

The permit to own is also a concealed carry permit, so in all non-NYC counties is possible to carry. Depending on the county this may be a pipe dream or very easy to do.

ETA: While permits are processed and issued by each county, a permit issued by my home county is valid in all parts of NYS, except the five boroughs of NYC, not just in my home county.
